Appeal Question

Hi All

Currently I'm awaiting for a date for my appeal, due to the fact that ATOS scored me a big fat zero on my medical assessment back in February and with that the DWP stated in there view I was fit for work...Would have been better going to Lourdes in France as maybe I would have felt the miracle of healing..lol

Anyway my back issue isn't much better, I still am in pain most the time, flying high on medication and under going treatment at the local hospital to get me into some sort of a decent way of living.... The injections into my spine in March have made no difference to the pain issue and currently waiting till the pain consultant sees me in June...
Plus the fact quite a few friends have noticed that I'm a lot within myself, maybe suffering from anxiety and some form of depression.... and this has already been duly noted in a medical report as my whole world last year came crashing down around my.... losing my 18 year career over this back problem....the general feeling that I've failed my wife and the kids, feeling bad about having to used the benefit system... I could go on but I wont

My question is what if at my appeal I get flipped off... or to put it simpler that I loose the appeal, even though I am still in a lot of pain and discomfort on a daily basis.


Will I be forced to sign on to job seekers and or do I
re apply to ESA ?

    You need to show that you meet the ESA descriptors in some way and I suspect that you did not complete the form in the right way. Using your back as the reason and not matching what you can or cannot do under the different descriptors.

    As long as 6 months have passed since the date on the letter telling you of the failed assessment, you can reapply for ESA.

    You'll be eligible to receive ESA assessment rate payment as long as your ESA claim if CB based is less than 365 days , or you're eligible for ESA income based.

    AS HUW advises, best to concentrate on your appeal.
