Aktiv Kapital advice please.

Hello, over the last year I have started receiving letters from this 'company', I have read up on this forum and it seems that this company seem to be less than reputable. Anyway, they are chasing me for an Egg loan which I paid off in full and final settlement in 2008!

Having sent them letters stating that this is in fact paid off and why on earth are they chasing me they continued so I took a screen shot of my Equifax account where it shows the account as settled in 2008 but they now seem to be ignoring me completely and they have now put a default on my credit score!

I have got Equifax and Experian to contact them but they have had no joy either, I need this taking off my credit file as we are wanting to move but this is holding us up.

I am at a loss as to how companies like this are allowed to trade.

Any advice would be fantastic,

    Do you still have the letters from Egg or their collectors confirming the F&F?

    You need to complain again to Aktiv, stating that this is now a formal complaint and that you demand a final response within 8 weeks of your initial complaint as you wish to take the matter to the Financial Ombudsman (FOS) and the Information Commissioner (ICO). You will also be reporting them to the OFT. They can only avoid this action by closing the account, ceasing collection activity, and removing any incorrect default data from your report.

    Thank you for your swift response.

    No, I no longer have the letter as I usually do a clear out every year and, to be honest, I figured I'd never hear about this again!

    I have also written to Canada Square Operations as, I believe they have taken over from Egg, to see if they can provide proof, I am still waiting on this.

    I shall take your advice though and write to them tomorrow.

  • By "full and final settlement", do you mean you paid it off completely, or that you agreed and paid a lower figure?

    Moorgate loan servicing took over a egg loans a couple of years ago. No idea why happened to the closed ones at this point.

    Does your report show partially settled? What's the balance?

    If in the settlement letter they do not confirm that they will not sell it on or chase the remainder and set the balance to zero, then they can do just that. Unless they used the words full and final settlement.

    Not necessarily. Settlement does mean SETTLEMENT after all. By definition it mean the matter is settled. It is advisable to get things spelled out explicitly though, just to cover yourself.

    To answer a couple of your queries...

    I agreed a settlement with them, they knocked £200 off the full £4700 balance.

    My report shows the account as settled and the balance is zero.

    It's a while since I read the letter but I am 100% sure it said full and final settlement.

    If your credit report shows settled then the original creditor must have told the CRA's that it was settled.

    That said, Egg must have still sold the debt on to Aktiv Kapital.. I think you need to get in touch with Egg/whoever has taken over Egg to find out why they sold the debt on even though it was settled.

    Perhaps time for a "Prove It" letter?
