faulty item on ebay but past protection period - help

hi all

I brought a tablet from an ebay shop, new in march. after a month it wouldnt turn off and kept freezing on a few ocassions, i contacted them and they did get back to me, giving me a few things to try. it worked and i didnt have any other problems with it.

then last night i turned it on and it wouldnt come on, despite being fully charged the previous day. i tried charging it but nothing, wont turn on, charge or anything.

ive contact them again but no response. i tried to open a dispute but its past the protection ebay offer so cant help me.

not sure what to do now? its only 2 months old so i dont expect it to already of broken.

    How long ago did you contact them? It is a Saturday night.

    Presumably you got in touch by email? If they continue to ignore you, do you have a postal address?

    No you BOUGHT not BrOUGHT. You do know there is a dedicated ebay board way below where this board is where you would have got ebay answers?

    So it went wrong on Friday night.
    Lauram25, really can't expect a response from them until Monday at the earliest.

    is there a 'hard reset' button?

    It's a consumer rights issue, not an ebay specific issue; the OP was perfectly right to post it here.

    I emailed them friday about 5ish so yes very possible they will reply on monday.

    even if they do reply im obviously worried they wont offer to do anything about it as outside ebay protection and 3 months old, so i wanted to see where i stood if they dont offer me any help really.

    im not quite sure why you felt the need to correct my one spelling mistake, considering when your example had a mixture of capitals and small letters?

    if i did know there was a dedicated ebay board below then i wouldnt of posted on here, so a kind response pointing me in the direction would of been more helpful then a narky reply. However, someone else has posted saying i have actually posted in the correct place.

    I came on here looking for help, so if you cant offer any assistance then please do not comment further.

    yes you are quite right, im kind of covering all angles in case even when they do reply they say they wont do anything as ive had it from 28th march.

    ive looked for a reset button and cant see one.

    the screen kind of flickers a different colour very slightly when i push the on button, but thats it, no other signs of life.

    You may well be outside ebay's protection time limit, but that protection is in addition to your statutory rights. Or to put it another way, Ebay will help you during that time, but after that you are on your own.

    You have rights under The Sale of Goods Act.
    If you purchased from a business then any fault that occurs within the first six months from purchase is assumed to be inherent (i.e. present at the time of sale but not necessarily apparent at that time), and it is for the seller to prove otherwise.
    If the fault is deemed inherent then the seller must provide a remedy, which could be either a repair, replacement or a refund.
    You get to choose the remedy but you cannot force the seller to provide a disproportionately costly remedy.
    In other words, the seller chooses the cheapest remedy.

    For more information on this it is probably a good idea to read MSE's Consumer Rights article, if you haven't done so already.
