If you were going lo use that as a defence you should stop at the time of striking the pot hole and not drive until the car gives up.

Do you stop & check your tyres everytime you hit a pothole? I doubt it, you'd never get anywhere!

The facts are that the OP ran over something causing damage to both front & rear tyres on the same side (verified by garage), whether he/she should have continued driving after noticing something was wrong is irrelevent, the damage to the rear tyre was already done & this is the tyre the FPN was issued for.

Why are you harping on about the front puncture?

I'm not, I just don't see your defence working.

I reckon it's got a very good chance & I'd go with it... whether the magistrates agree is another matter!

exactly what was the offence you've been reported for?

    [Exact wording, if possible?]

An offender would only receive one set of penalty points, if multiple offences of the same type were reported at the same time.

At worst, the reports from 'professionals' can be submitted as mitigation.

This may impact on the level of fine imposed.....but may not affect the issue of points.

Posting for information on the forum link below may well elicit accurate advice from Police and Magistrates.....non-judgemental, but might not be what some people like to see.

No, I don't think all other drivers are idiots......but some are determined to change my mind.......

Last time I looked at that forum 50% thought that an expired photo on a driving licence meant the licence had expired & driving was illegal.... hope they've improved ;)

ETA: Just looked & nope, they haven't improved.... it's no better than any other forum & worse than some ;)
However you can put your car into an MOT test ANYTIME... many sellers do it, to give the car a full years MOT on selling it... as any new MOT will invalidate the old one... pass or fail.

what are hardshoulders for and emergency only laybys? portly thinks its to check your tyre pressures after hitting a pothole? anyone disagree? or should everyone stop on a slip road to check their tyres after a pothole they just hit on a A road bypass or motorway.
hang on ill drive down the M4 hit a pothole and sit in the fast lane get out and check their ok to travel on.

    DOH!!

Well since the op drove past a layby can you give a valid reason why they couldn't have stopped and checked?

To damage two tyres would not have been an insignificant passing would it?

The op has already stated it was their intention to complete the journey regardless of any damage the car may have sustained. You may feel that's ok. What if the tyre had given up and they had run over one of your kids?

i dont let my kids play on motorways, bypass,or mainroads.

it was her intention to complete the trip after she hit the pot hole as the car didnt feel any different, later in the trip she noticed as the tyre deflated. it would have been safer to get to a place off the A40 rather than stopping in a layby and being swipped by a artic lorry and getting herself killed, unfortunately the tyre gave cause to stop she was unable to carry on regardless and had to stop on the slip road, hardshoulder wich is a bit safer as traffic would have been slowing for the junction ahead not much safer bit atleast out of mainstream fast flowing traffic.

if she had stopped in the layby, she would have got a ticket for stopping there in a non emergency, same as the hardshoulder what are we doing stopped here im checking my tyre pressures and tyre conditions, i hit a pot hole, not good enough reason to endanger yourself and others!.

being in the forfront of her lessons, in the event of a blow out coast the vehicle for as long and as farr as practical as you can, DO NOT STOP IN A LAYBY OR HARDSHOULDER UNLESS IT IS AN EMERGENCY! and if your unfortunate to breakdown where else other than hardshoulder/layby can you go!.

    A ticket for what?

You can stop in an A road layby to eat your sandwiches. Ever seen a burger van in one?

You do realise this was on the A40 and not the M40 don't you?

You need to brush up a bit before you take your test.

unless clearly sign posted emergency only layby or marked no stopping or police patrol vehicles only. not ALL A road laybys you can just pull into to pee on a tyre or make a phone call ;)
sorry yes i know the A40 raglan to england its motsly littered with no stopping signs and SOS only laybys with clear signage that explains the penalty for stopping in a emergency layby for a pee certain area's designayted as rest area's now thats established i bid you farewell. A40 london is a redrout no stopping signs periodically!.
