then you just have to be patient until you see the doctor
the doctor will prepare a report which can take up to 6 weeks for your solicitor to receive
once received they will be in touch with you regarding the report and once you are both happy you will need to sign a paper saying your solicitor can disclose it to third party then your solicitor if liability is still an issue your solicitor will take third party to county court and once they receive the court paper they will have to reply or their insurer will have to pay up if there is no witness then its more likely to be your word against theirs so it might go down as a 50/500 -

Thankyou for the info, there was a witness but I didn't get his details although I know where he works so might be worth me getting them.
Thanks again0 -

get the witness details and pass it on to your solicitors
please please please do not fake it!! if it goes to court they might have to attend and you will be cracked by the other party0 -
I would start a complaint with co-op - either in writing or ask to speak to the complaints department. If the third party isn't responding to them, then I would expect them to just pay out. I don't know if that's legally the case, but that's what I would say is reasonable.....
According to the OP CIS are the insurers of the third party. As such, any complaint would be filed away in a special bin.
Why would the just pay out without speaking to their insured?0 -
This happened to me, hit by another car and had witnesses, driver admitted fault, gave me her insurance details then refused to contact her insurance. My insurance company contacted hers stating there had been a crash and there were witnesses, her insurance company wrote to her asking for her side, she didnt respond they then wrote again giving her a time period to respond or her insurance would pay out, cancel her policy and seek damages from her. It took about 4 months but my car was fixed.0

Hi all , i spoke to my solicitor for the injury and my insurers today , my insurers have told me that the company will accept the claim "without prejudice" that basically means "no admittion of fault" apparently ?
I dont fully understand and hope someone can elaborate ?
my insurer wont give me a hire car as there is no admition of liability yet and they say they wont do anything until the 3rd party responds directly to them (which he hasnt done for the last 5 week)
where as the injury solicitor says the injury claims should be fine and the company should be providing me with a hire car they wont and say they will not go any further until they are contacted by the 3rd party?
its a bit mess that i dont really understand , so will everything be ok but i wont recieve a hire car ?
Are accidents happen not forwarding the claim because they want there own garage to do it rather than co-op sorting it out ??
I need a bit more advice. thanks!0
