Can I Reclaim Bank Charges from 6/7 Years Ago?

Hi,

About 7 years ago, my partner at the time left the country leaving me to pay for our flat and all of the bills on my own. At the time, I was earning a small wage and was struggling to keep on top of it all. I stupidly had an overdraft facility applied to my bank account to use to get me by but this started off a never ending cycle of increasing the overdraft to a maximum amount and then having charges upon charges.

I have gone through my bank statements at the time and have just under £1000 worth of bank charges. £25 here and £25 there. On one day alone, I incurred £75 worth of charges. At the time, I was in severe financial hardship.

Fast forward to the present day, I earn a lot more money, am no longer in financial hardship and have repaid every last penny to the bank including all of the charges.

Can I reclaim them? Does the financial hardship rule only apply to current circumstances or the circumstances at the time of incurring them?

Thanks.

The banks will not even consider refunding any of your bank charges under the financial hardship basis, if you are not currently in financial hardship.

Even if you were currently in financial hardship, banks do not usually refund charges of more than about 6 months old.

By your own admission you "stupidly had an overdraft facility applied to your bank account", ie: you chose of your own free will to apply for this. The potential charges would have been clearly set out at the time, and why you appear to think that the bank was in some way at fault and the charges should be refunded is beyond me.

Thanks for clarifying. The debt is completely repaid but just wanted to know where I stand. Lesson learnt :)

    As for :-

why you appear to think that the bank was in some way at fault and the charges should be refunded is beyond me.

Where have you been the past god knows how many years??!! There has been around £1bn already refunded for the same reason I was stating. Look it up!

Up to the point the court case started and the banks won that.

That could perhaps be aimed back at you seeing that the court case was won by the banks in 2009. ;)
