Indemnify???

Hello,
I posted before regarding an event which did not go as advertised. The promoter agree the event was poor but didn't offer any refund.
I contacted the venue (who was also the box office) and they tried to wash their hands off it saying its got nothing to do with them as they just take the money.
I told them that is similar to paypal yet they have a duty to sort out disputes and refund wronged parties.
SO I sent off a letter before action to the box office and got a letter back saying in the T-C's there is a part which indemnify the box office from any charges and that if I went to court they would counter claim for all legal fees.....
Any help?

I can't actually see that you've posted about this before.
What was the event?0 -
Have you got a copy of the T&C's the box office in question 'abide by' - they may actually be 'unfair' terms and conditions but without seeing them it's hard to comment. Nevertheless they cannot put on 'rubbish' shows and expect customers to put up with them and try hiding behind T&Cs. I fail to see, however, that fair T&Cs would, by the nature of them being fair, indemnify a company or organisation against action being taken against them.
I assume you still have the evidence of the timings of the event and how they differed to those advertised?
Thing is, if it came to court then it would be up to the court to decide. Your case would be stronger if others complain and/or with evidence that what you saw was not what was advertised.Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily DickinsonJanice 1964-2016

That's the one!
(All I could recall was that it was something to do with Scotland. Vaguely, that is!)Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily DickinsonJanice 1964-2016

It was belfast but he was suing under Scottish law. When this was pointed out to him he started going on about trolls. He then started pming me abuse and the thread ended up being deleted. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

though it may have been the Scottish law bit I recalled - like I said, 'something' to do with Scotland. It's all coming back to me now...Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily DickinsonJanice 1964-2016
