Worried about claiming

Good evening

I'm in a bit of a pickle and hoping for some advice. Sorry if this is in the wrong section.

Last month an uninsured drink driver drove into me while I was driving a company van while I was sat at traffic lights. He hit me at a good 40-50mph and wrote both mine and his van off.

My boss (who is also my dad) bought a new van straight away and then settled a claim through his insurance company for the cost of the written off van. Because the driver of the other vehicle wasn't insured I presume my dad's insurance company had to claim through the Motor Insurers' Bureau.

Now I'm not into the whole claiming for personal injury business and wasn't hurting at the time apart from a bit of back ache after the accident. Since then it's got worse and i've had 3 trips to the physio to try and sort it out, so i'm thinking about claiming.

My boss (and dad) is very anti-claim. He'll say "it's only a bit of back ache get over it, only genuinely injured people or scum put in claims."

I'm going to claim, because physio trips cost time and money and i'm getting fed up of my back hurting. But first I want to know that it definitely won't affect his insurance premium?

Because I can see it being a very sore point if I end up claiming for personal injury, then his insurance premium goes up.

Is it anything to do with his insurance company?

Will his insurance premium go up if i make a personal injury claim?

Any help i'd be very grateful!

  • So do you think his insurance premium will go up from the accident, even though it was 100% completely someone elses fault?

Your claim will be against the MID unless the vehicle that hit you had a policy covering the car (The driver who hit you does not need to be covered)
  • And thankyou for the reply!
  • So if I were to make a personal injury claim. It's between me, whichever solicitor I use and the MIB?

Not really anything to do with my dad's company (which owns the van), or the insurance company he uses?
