Council Tax after Probate

Hi all,

I have just been to sort out my late mums property and found a lot of bills I hadn't expected from the local council. They are charging me from 14 Dec 2012 and probate was granted in Sept/Oct (we are looking for documents to confirm the date).
I am being taken to court for non-payment but my understanding was that the property was exempt for 6 months after probate was granted.
Was I terribly mistaken???

Mum to Moo age 6, Wills aged 3. 2nd wedding anniversary 11/13!

    I also believe that the council tax isn't payable until 6 months after the grant of probate.

    Have you been in touch with the council to see what they say? Are they aware that your mum has died and did they know the date probate was granted?

    I think it's more than likely they just haven't got details of the current situation, I'm sure a phone call will sort it out

    Only if the property ownership has not been transferred - once the property ownership has been transferred the Class F council tax exemption no longer applies.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

  • Morning and thanks for advising. Probate was granted October 23rd, I will find out the date on which the property was transferred into my name.
    I'm selling the place to buy a family home and getting worried that it will affect our mortgage plans etc. I'm waiting to get together all details I need before writing a letter recorded delivery. I can't afford this bill, though, that's my biggest fear - in all honesty we barely make ends meet now and hubby and I both work 40 hours a week. Extra financial strain is going to be a big problem.
