Can someone advise on redundancy pay for p/time worker

My husband was made redundant this morning after a brief conversation with his "boss" on the 'phone, who made no mention of redundancy pay to him, but just told him he'd be paid up to the present time.

I'm after some advice to find out what he's entitled to and would greatly appreciate any help from someone "in the know".


He's 56, has worked 2 days a week for the company for 6 years and one month and earns £112 per week. He's never seen/signed a Contract of Employment, so I don't know what affect, if any, this will have.


I know he won't be due much, but would like to be armed with the relevant info., in case we have to push to get whatever's due.

    He has over the 2 years service so should get it (based on his age 1 1/2 x 6) - 9 weeks pay plus notice pay of 6 weeks (1 week for each complete year of service).

    Plus there should be payment in lieu of any holidays accrued but not taken.

    However from what you have said it does seem doubtful as to whether it's a true redundancy situation. Was there any mention of layoff or short time?

    The holiday situation doesn't really apply as they are taken from April to April.


    Isn't a Contract of Employment a legal requirement? If so, I wonder if they'd be more likely to pay up rather than this being highlighted by any legal action, or is this wishful thinking?

    Unless he has used some holidays during April then he is still due something. April 1st till now is 5 weeks plus he earns holidays on notice, so that is 11 weeks worth of holiday earned which is about 2.6 days holiday.

    I'm confused by the notice period that should be given by law : it appears to be 6 weeks in my husband's case, but he was given no notice.

    On the government website, it states that you can only be paid in lieu for the notice period if it's stated in your Contract of Employment. As my husband has never seen/signed one, where does he stand I wonder?

    Can anyone advise?

    If the company are not allowing him to work his notice then they must pay him for it.
