    Have you thought about claiming pension credit instead? That is payable to a female or male from 60 years old until state retirement is reached, but your income may preclude it. Why not use the benefit checker tool on here to play around with different scenarios - link can be found at top of this thread.

    Pension Credit may only be claimed when one partner has reached pension age.

    I'm going to get in contact with my MP Mike Penning.
    Imagine if we had a mortgage or rent to pay.
    I have a couple of small Endowment policies but they will not mature for a couple of years...so i need to keep the payments up.

    Sorry, I don't think you understand the purpose of the benefits system in this situation. It is to maintain a minimum standard of living, not to ensure you can keep up endowment payments. In fact, those endowments will have a trade in value now, and would be counted against your means tested benefit entitlement.

    If you had a mortgage or rent to pay, your housing costs would be counted as part of your 'applicable amount'.

    Yes i get your meaning..but im not prepared to cash them in and lose thousands.
    These policies also have Health Care components attached which i need because i don't keep that well even though i work full time.

    Does your wife have any care or mobility needs?

    If so, she may be entitled to Disability Living Allowance. This is not means tested so any pensions or your income will not make her ineligible.

    If you google Disability Living Allowance you can read about the critieria.

    She is not that disabled so DLA will not be granted.

    Was she on Incapacity Benefit last April? and for the years before this?

    Was she found "fit for work" or WRAG in May last year?

    Why did you say "JSA" in your OP?

    Has she had her Tribunal hearing? What date? What was the result?

    Right, then she has a 365 days contributions allowance on appeal and then you have to support her. This is the law, your MP will not be able to change anything.

    If she wins into WRAG she will get arrears ONLY for 52 weeks. And her claim will remain open for NI credits only i.e. £0.00

    If she wins into Support Group she will get 52 weeks arrears PLUS continue to get full ESA rate from the exhaustion date. (the 365 day date)

    If she loses the appeal she can make a new claim for ESA NI credits only (£0.00) or JSA NI credits only.

    If you work 24 hours or more a week then there is no point completing the ESA3.. her NI credits will continue anyway unless she loses the appeal.
