AGE DISCRIMINATION - It's the law!
Get a grip if its the LAW!!!!
Try being unemployed and being LEGALLY discriminated against!!!We’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -
Hi Elsie,
What a supportive mam you are:T:T we all want the best for our children and times are particularly tough at the moment. Not sure I can advise but wish you lots of luck.To do is to be. Rousseau
To be is to do. Sartre
Do be do be do. Sinatra0 -
This is not the way we want to live. I work, he wants to work, and I want him to work and am proud of the fact that he wants to work! Now to find someone who will give him the chance, even if only to be able to apply. Cash in hand is not the way I want to go with him, it's sets a bad precedent in my opinion.
I wasn't commenting about the way you want to live, just pointing out that age disparities have a way of working themselves out.0 -
Im not sure about all the rules and regulations - but maybe he should try to get into a local business. They may be cash in hand etc but its a start.
Is there no 'connections' type centre he can go to for after school careers advice?
I worked from the age of 13 - 16 in a bakery, cash in hand. They take on young people still now part time to serve cakes etc.
Definately try local small businesses, I think this is going to be his best bet due to the regulations corperate companies are subject too.
Best of luck, xx
Unfortunatly......

It's replaced here with 'Help you Choose.' Guidence on college, apprentaship ect. Not the help that is needed as he went for college interview and had a confirmed place a few weeks ago. But I still hopefully have places for him to turn to for advice.
Thanks for wishing him luck, you are one of only a few on here who seem to be in support of what we are trying to do.
All I want is for him to be on a fair playing field to apply for 'ALL' part time summer jobs available to anyone age 16 and over, and not be restricted in just poping down the local shop on the off chance. He will only get a job on his own merits, but to not be given the opportunity for him to apply I think is so so unfair.0 -

Basically this page says a child can work part time from the age of 13. Once they turn 18 they have employment rights and rules to protect them.
If one were to employ a child they are subject to lots of restrictions:
Children are not allowed to work:- without an employment permit issued by the education department of the local council, if this is required by local bylaws
- in places like a factory or industrial site
- during school hours
- before 7am or after 7pm
- for more than one hour before school (unless local bylaws allow it)
- for more than 4 hours without taking a break of at least 1 hour
- in most jobs in pubs and betting shops and those prohibited in local bylaws
- in any work that may be harmful to their health, well-being or education
- without having a 2-week break from any work during the school holidays in each calendar year
These restrictions themselves do not put <16 year olds and adults on a level playing field so discrimination won't apply. It's like comparing apples and oranges, sorry.
This only applies to children still in full-time education, it is to ensure young people who are in education are not also being forced to work full- time or without the knowledge of the school.
At 15 once you reach the school leaving date, you will get an NI number and join the ranks of the taxable.
You can work at age 15 but no more than 40 hrs per week and not after 9.45 in the evening, there are a few more protections which are the same as for any young worker under 18.
Not sure you could prove age discrimination, however it is a bit of a common understanding with employers that it is illegal to employ a 15 year old full-time. It is such an unusual situation for a 15 year old to apply for FT work having left school that it rarely comes up so there are common misunderstandings.0 -
OP why don't you think we don't wish your son well, it's your view that somehow he's being discriminated when it has been said that when he reaches 18 those regulations come into force, and then there is proving it and that would be the hard part even at application stage isn't worth the fight.
The suggestions other have made are good ideas, but I'd have thought you'd have already thought of those and inquired.0 -
I have to say that's it's very bad netiquette to try to rustle up support for your point of view on other threads.

It's also quite unnecessary when people are simply pointing out the facts of the situation, rather than arguing against you.0 -

He, my son, has......
But he has been looking at advertised part time jobs locally and when they say he must be 16 to even apply he gets so disheartened. What I want to find out is if these employees are doing anything wrong by saying applicants MUST be 16. Ok so they may not have insurance, but should they by law have to have it? There can be, (and in this case is) 2 months between 'legally leaving school' and 'becoming 16'. Can someone please quote where it states that the discrimination act does not apply until 18, as I can't find anywhere that says it.
All I can find is this page on the CAB site....
http://www.adviceguide.org.uk/england/work_e/work_discrimination_e/age_discrimination_at_work.htm#who_does_the_law_apply_to
And they mention jobs where a person has to be 18 to do them by law, so must in the rest of it be referring to under 18's as well???? It also says the law applies to you if you are 'quote' Applying for a new job.
Oh this is getting me more and more wound up as I go along, I think there is more to look into next week once office hours resume.0 -

All I am wanting is the best for my Son.... and any opportunity to find potential employers who might consider giving him a chance! Is there anything so wrong in that?????
And I don't believe 'some' of the early quotes on page one are true facts either. I beg to be corrected if I am wrong.0
