Wife on Maternity Leave Unfairly Dismissed?

But there's no indication so far that her contract is not being renewed because of her maternity leave.
Op says other unqualified teachers have been kept on hence the reason for non-renewal does not make sense. This could point to the reason being something else e.g. Maternity.
If op's wife can establish facts that could point to discriminatory action the burden of proof is on employer to prove otherwise."fools and fanatics are always so certain of themselves, and wiser people so full of doubts." (Bertrand Russell)0 -
But other woman must of been on Mat leave at some point why now?...it doesn't make sense. They don't get anything out of dismissing her (unless they employed someone on a temp contract over her job and want to keep temp full?!)
If they've already paid for Mat leave and you'd think 99.99% wouldn't hold it against them(so as to dismiss them after when they could) that they had a child & a school is funded by the goverment so its not like anyone has lost out because of this.. I wouldn't of thought?
Maybe they just didn't like her and that was thier polite way of telling her they wasn't going to renew.People don't know what they want until you show them.0 -

Just making you aware that there is no legal obligation for some schools to employ qualified staff. I believe the only legal obligation is that they pass the CRB check!
I'm not privy to the reasons parents choose independent schools; although I know that many of them make a great show of their smaller class sizes and extra-curricular activities. Whether they broadcast what, if any, qualifications the staff have I don't know.
Not saying I agree with it, at all. But if people choose to have their children educated outside the regulated state sector maybe there are some questions they should be asking as they select schools.Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily DickinsonJanice 1964-2016

Make sure she gets the reasons for non-renewal of contract in writing.
Get in touch with her union, this is bread and butter stuff for them. If she's not in a union though you may have to think again about fighting this, it's likely to be an expensive process with no guarantee of sucess. Take some legal advice with a lawyer who specialises in employment law and who will give you some indication of whether you might have a case or not. You can get no-win-no-fee lawyers of course but they tend only to take on the likely win cases.Val.0
