Bank charges reclaiming

I have been in a trust deed for nearly 2 years now.

I have been told to check back and see if I have any bank charges, I do have quite a lot of charges.

Am I able to reclaim these under hardship rules seeing as I am in a trust deed?

Any help is appreciated

You can ask the bank but seeing as the trust deed involves you sorting your issues out and the charges being pre-trust deed, you wouldnt be entitled to the money if they did decide to refund.

What would happen to the money and would i be able to reclaim next year when my trust deed is finished?

Whilst in thr trust deed, you would need to advise your truistee of any windfall payments. I would fully expect the trustee would insist the funds be added to your estate to recompense, at least in part, those you've welched on.

No point attempting to reclaim next year the charges you've already incurred - it'll be too late.

No. Any payment out would go to the trustee to pay those you failed to repay. Only if there is enough to pay them and some left over would you see anything.

The whole point of a trust deed/bankruptcy is to draw a line in the sand to allow you to move forward. You cannot pick and choose from things before that line.

You should get some free legal advice. If the FOS have agreed with the bank, and they've already made you an offer to resolve this, i think you're probably at the end of the line now. Maybe a solicitor will have some different advice for you.
