Can I keep goods which I haven't ordered?

    Unsolicited Goods

    "Unsolicited goods are those that have been sent to you 'out-of-the-blue', that you haven't ordered. The Distance Selling Regulations now say that you can treat these goods as an 'unconditional gift', in other words, you can keep them or give them away, sell them or use them or destroy them, and the trader cannot expect you to have to pay for them."

    What they sent me wasn't anything close to what I had ordered. I didn't mean to sound snappy before, I was simply trying to clarify what you were saying. It is so confusing because as far as I'm concerned they have sent me something which I didn't order. It was sent to me out of the blue. There is nothing on those regulations to say that you must have never have ordered from the company before.

    If I found a diamond ring in the street, I would hand it in - I'm not a thief or callous. But if something is forced into my posession (sp? - getting late!!) when I didn't request it, I don't see that as being the same. If I was careless and sent something to the wrong address, I could not expect it to be returned or be in anyway compensated for the loss (unless I had paid for insurance) as it would be my own fault.

    I don't understand why what has arrived is not deemed to be unsolicited. They have not sent me something that is not worth a fortune it is just a bit more than I bargained for. I guess I'll just have to wait and see what happens I guess. If they ask for it back then that isn't a problem, I just wanted to know whether I would have to. I value your opinions, I'm just trying to get some clarity on my rights.

    Survey completed - November 2006
    Searches completed - January 2007
    Vendor pulls out January 2007 - Aaaagghhh :mad:
    Offer accepted on next house - January 2007
    Survey completed - February 2007
    Searches sent - Febraury 2007
    Exchanged and Completed March 16th 2007!
    Phew!
    Decorating started 5/4/07
    Bathroom ripped out 18/3/07!

    Baby due 23/4/07!
  • I came home from work last weekend and found a wrapped parcel in the shaped of a flower pot and a little card stapled to the corner.

    It read Mrs Davies, No. 7 Moneysaving Path.

    I have had deliveries wrongly sent to me as I live in No. 7 Moneysaving Close and one leads off the other.

    Now i must admit the thought crossed my mind to keep it, but only for a second cos I knew the original person who ordered, would have phoned the flower shop to enquire why the pot wasn't received. Of course flower shop say they did deliver and say where, i then get sussed and asked to pay?

    Anyway i did take it round and rang bell, no-one in and left it on doorstep.

    I would have felt bad as i suspect an elderly lady lives there and probably one of her relatives sent it, so i couldn't possibly think about keeping it, more than the few seconds i did slightly entertain the thought.

    Well i am human......:confused:
