Can I keep goods which I haven't ordered?

    Are you saying that they sent you goods that you ordered but that they are sending you the same goods again without you ordering them?

    Or were the goods you received two months ago not ordered either?

    You haven't received them yet, so, how can you send them back? ;)

    You were phoned to confirm the order/delivery of goods - if you have already received the goods a few weeks ago, you already *know* that the delivery is a mistake.
    I don't see that it comes under The Unsolicited Goods Act 1971 - in the above quote it states: "....for goods sent to a consumer without that consumer's prior consent" - but you *have* consented to the delivery of those goods.

    If it's a mistake (goods you haven't ordered, or even a duplicate of goods you *have* ordered) you have been given two opportunities to point out the mistake: 1) when they phoned to arrange the delivery 2) if/when you accept them when delivered.

    I would advise against storing them and waiting to see what happens.

    I agree with Queenie. These are not unsolicited goods - it's a duplicated order. Unsolicited goods are those that turn up out of the blue e.g. here's 3 books, if you want to keep them, send us £10. Funny, how those offers don't appear anymore ;)

    I have a feeling that you have a duty to inform the supplier that you've recieved the same goods twice ... need to look that up.

    If you want to adopt "the moral high ground" then you would, of course, politely point out the supplier's mistake. Depends on your conscience and whether keeping mum would spoil your sleep pattern ;)

    if your worried now that you dont want them but they delivering them anyway just refuse delivery.. drivers will try and convince you to have them and they will pick them up later etc but dont do that as you will have accepted the goods... ps if they not unsolicited goods and you store them and they get damaged they might make you pay..

    What you have to ask yourself is .. can i afford these goods because i might be forced to pay for them... do they have your credit card details they might be billing you as we speak ..

  • No they don't have my credit card details. And no I probably wouldn't be able to sleep at night if I was to keep them, we are talking a whole lot of items!!! It's not like its just one. I'm sure I would be breaking the law. I should phone them and tell them there has been a mistake.
    But like queenie said, they arn't even here yet, the lady could of just made a mistake at the other end of the phone, it could of been her first day or something, poor thing!

    like i said if they turn up just refuse them and tell the drivers its a duplicate order.. they can then take them back to whoever sent them..
