Please could you provide the link to the legislation providing this exemption from the VEL laws?

I am familiar with the exemption from the requirement to have an MOT in this situation, but not the VEL requirement.

It would be an exempt vehicle - Schedule 2, 22, Vehicles Excise & Registration Act 1994.

    http://www.legislation.gov.uk/ukpga/1994/22/schedule/2/crossheading/vehicle-testing-etc

Which also exempts it when it's being driven back from the test (so you don't need to leave it at the test station while you arrange tax) and being taken to (or from) "a place" for work to be done if it fails. It doesn't need to be a garage or repair business, driving to "your mate who's good with spanners" is fine as long as you arrange it beforehand.

Yes it has always been the case that you can drive insured, without MOT (regardless of what your insurance policy document says about needing an MOT) or Tax to/from a pre arranged MOT appointment, with reasonable diversions for fuel, or to stop on the highway to visit a shop to get refreshments, take a leak etc.

There is no exemption, however, from roadworthiness or construction & use regs. This is ignored by most people and probably by most police (except in extreme cases). But if you drive a vehicle away from an MOT station with a C&U fault you would not have a leg to stand on if anyone bothered to write you a ticket.
