Working during notice period

Hello everyone

My dad is being made redundant along with 19 others. He has 12 weeks notice and I understand that if required, he will have to work this period rather than being dismissed with pay. However it seems that 18 of the others are finishing tomorrow and don't have to work their notice and the other 2 being made redundant do have to work. One of which is my poor old dad. Can someone just confirm his position? Will he have to work regardless of the other 18 people? I think he probably does but just wanted to check. If he refuses, what will happen?!

Also, the company can't withdraw redundancy can it?

    Yes, if required he has to work his notice regardless of what the others are doing.

    I would imagine if he refuses to work his notice he is likely to be dismissed rather than be made redundant so losing pay he would have earned during his notice period and his redundancy money.

    And yes, redundancy can be withdrawn/or the end date extended. If you are in the statutory notice period and receive a job offer you can serve counter notice to ensure your redundancy but that is the only situation as far as I am aware

    Trying to motivate people who are made to work their redundancy notice is difficult at times, quite often a financial incentive is used.
    e.g. "work normally until the end and we'll give you an extra £xxxx on top of your redundancy"
    Depending on what sort of job he does, I'd expect that he'll only be doing the bare minimum required and and caring little about the job.

    Thank you both. he has now told me that they have written to him and the letter states the following -

    The Company is obliged to inform you that your employment could be terminated atthe conclusion of this meeting (final consultation meeting 3rd May).

    If you are made redundant you will not be obliged to work your notice. However as discussed with you during your last consultation meeting, I have requested that you may work during your notice period and an incentive payment would be made if you agreed to do so. This will be discussed further on 3rd May 2013.

    Does this change the situation bearing in mind that they have stated in writing that he is not obliged to work?
