Ebay - 1 not as described & 1 damaged in post

I seem to be having a run of bad luck lately with ebay purchases, I find getting answers from ebay like digging for gold so can anyone help me with these two:
1. Item not as described - Was a fake and worn when described as Branded and New. Seller claims ignorance but has agreed refund, what am I entitled to: item price, item price + original postage, item price + original postage + return postage?
2. Item damaged by Post Office - item didn't arrive told seller and they said wait a bit more, waited and contacted again and said wait some more. Now they have finally agreed to send a replacement - 1 month later (hasn't arrived yet) and today the original item turns up broken with PO apology. What do I do? The PO say a claim can be processed but should it be by me or the seller? Or shall I just ignore it, the seller as I say hasn't been especially helpful.

1. You'll get back price+original postage if you send it back to the seller tracked. If the seller is nice he can choose to give you your return postage too.
2. Seller will need to claim for damage.0 -
On 2., I would put retrun to sender on the Royal MAil bag and drop it in the post box with the sellers address on it.Warning: any unnecessary disclaimers appearing under my posts do not bear any connection with reality, either intended, accidental or otherwise. given its all about to be privitised
it would be good for folks to work out the difference
for the broken item,I would hold off and wait to see if the replacement arrives.

Sorry yes, Royal Mail.
Item 1 saga continues, seller doesn't know how to refund my money - what are they expecting me to say?
Item 2 - I'll wait till replacement arrives then let seller know and they can choose what to doWe Made-it-3 on 28/01/11 with birth of our gorgeous DD.0
