Parking in a communal yard

Hi All,
Posted a couple of times now..
I've been looking at Tyneside flats to rent recently, and I think I've found one I want to move into.
The flat is ground floor, with a door in the kitchen extension to the rear yard. The first floor flat has their kitchen and bathroom in the same place (former pantry/scullery).
Usually, these Tyneside flats have a rear staircase down to a shared yard, although I don't recall seeing a door to the upstairs flat in the rear yard. The agent tells me the yard is shared, however, there is no access for the upper flat. She doesn't seem to be able to tell me if I can park there or not.
Even if there is access to upstairs, the yard has an up and over garage door. Would I get away with parking in the yard if it's shared? (the flat above has recently sold and is vacant).
I don't use my car most days and pedal or bus to work, but I can't afford a flat with secure parking. I dislike the idea of leaving my car away from the house. (the front street has marked bays at the sides, but they are first come, first serve).
This yard is actually a strong pull on me taking this flat, as it's a reasonable size and could quite easily take my car (which is quite large). I was hoping that it'd be a first come, first serve thing, if I set a precedent for parking there, the new upstairs resident would accept it.
Any advice appreciated.

Looking at the draft copy of the tenancy agreement, it mentions nothing.
Not entirely sure how I'd access the lease. Generally speaking with a Tyneside flat they use a crossover lease.0 -
Can the agent not ask the landlord?0

I think the landlord is quite absent by the sound of it - to me it seems like the agent handle repairs etc etc without doing anything other than charging the landlord at the end of the month.0

That is, if I get issued a key for the up and over door... Of course, as there's also a side gate. I'm assuming that somebody put that door in with a view to parking in there at some point, there wouldn't have been one originally.
This is the rear of the property in question, the door on the extension appears to lead to the flat next door, so I can't see any rear access to the upper flat, however, there did appear to be an understair cupboard at the rear of the ground floor flat. :S0 -
Hi All,
More in the pot. I looked at the upstairs flat last night, which has come up for let. The agent letting that flat told me the rear yard belonged to the upstairs flat and although there is a door to the ground floor flat, it was just for access. I don't think this is the case.
I've made an offer to rent the ground floor flat, and when I spoke to (another) agent today to put the offer in, she was certain that this was a shared yard and it did not belong to either flat. She does, however, say she has the only set of keys for the up and over door!
