Asda (again) parking ticket

    I had a parking fine from outside York Cathedral, got away with it by downloading a 3 part form online

    Done a bit more research and photography.

    None of the pay and display signs mention Smart Parking Ltd This is breach of the Company (Trade Disclosure) Regulations 2008.
    The address they give for Town & City parking is also incorrect (according to their own website which lists a different one)

    Signs are not "Clear and easily visible" One on entrance to car park is overshadowed by larger better coloured "joyriding sign" plus it is on exit from a roundabout and right next to a pedestrian crossing (where would your eyes be) and the main one by main door of Asda is partially obscured by Asda flower displays, at least it has been this week.

    Have now reported all these faults to the Trading Standards.

    For anyone interested in who owns the car park (sure it is prob same in other Asdas ) They are owned by McLagan Investments Ltd.. a subsidiary of Walmart and registered to the same Asda head office address in Leeds and have same directors as Asda.

    Coincidentally I got an invoice from Smart Parking too, so yesterday also took the opportunity to report the sign errors to Trading Standards.

    I got some waffle back, but hopefully if enough people complain eventually Trading Standards will do something.

    Not sure what you mean but you don't 'get away with' fake PCNs. They are not fines if they are not from an authority like the Police or Council.

    Good for you, reporting them to TS!

    Let us know in a month when the Notice to Keeper arrives, unless you get it cancelled by Asda in the meantime. Try a stiff complaint letter to the Head Office address if the local Store Manager is useless but don't give up on the complaint. The CS Desk person was not the person to complain to.

    Thank you for your email about the Parking Charge Notices you've received after using our Lancing store.

    I'm sorry you've received up to 5 of these recently. I understand as the company who issued them is chasing you, you're starting to feel harassed. I appreciate you don't expect to be penalised for parking outside one of our stores.

    I've spoken to my colleague Caroline, who is part of our Admin Team, at Lancing. Caroline has explained the front of the store has double yellow lines and parking as such is not permitted due to the law associated with them.

    The company who patrols this area and the car park behind the store will issue a Parking Charge Notice if customers park on the yellow lines. If this is the case, then you would have to appeal to the company directly.

    Caroline has explained the car park at the back has lots of spaces for customers to park easily. We use companies to patrol our car parks and surrounding store area to ensure customers are able to park with ease.

    I trust my email has explained our view point and should you appeal, I wish you every success. Should you need any further help, please call me or one of my colleagues on 0800 952 0101. Thanks again for your email.

    Ask them to supply the legal authority they are using for parking there, ask them for a TRO from a council , and ask them how a private parking can give tickets that is backed by statute law. Inform them that the council trading standards would be interested in the claims of authority that asda are claiming.

    Also tell them that you are a customer of their store and getting harassing letters from their agents is going to lead to claim against them, the parking company and the debt collectors used. Say that a letter before action is about to be issued, and you will be claims at least £500 for the harassment.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
