Not received full amount

Hi, Don't know if I have posted in the correct slot, but here goes. I very stupidly sold an item of furniture to someone reasonably close (don't know her) through gumtree without getting the full amount straight away. She sent me an email on the morning of delivery saying could she pay me £150 in cash and transfer the rest to my account (another £150 as she was only allowed to draw out £150 at anyone time. (yes I know she could have gone back there two days running!) Failing that could I collect the rest of the cash when she could draw it out the next day (she can't drive and the nearest cash point is miles away). i said yes to the transfer, but now I am worried. i have tried ringing her and emailing her but no reply. Admittedly it is only a day ago, but I asked her to transfer the money the day of delivery. What rights do I have if she doesn't pay up. i have a bad gut feeling about this. I don't want a fight on my hands so anyone know what I can do if if the money isn't fortcoming. I may be getting my knickers in a twist too quickly but just want to know just in case. Thanks folks.

    Do you have her address?

    You could go to her house and confront her but otherwise I guess its smll claims court route. If you don't know where she lives, you might struggle.
  • Yes I do know where she lives as we delivered the furniture, so at least you are right, I do have that up my sleeve. But what are my rights to take the bed back if she doesn't pay the other half.

    Assuming the worst and she's a scammer, even though you know her address, I suspect she'll simply lie, claiming she has already paid you the other £150 in cash, making the full £300 - I can't see how you could prove she didn't, making it a case of your word against hers. She'll most likely then claim you are harrassing her for money she doesn't owe.

    Well do you have any proof that she agreed to pay £300?
  • Yes I have a text message saying exactly what I put above, that she would pay in cash the £150 and the rest either by transfer etc etc. I also have gumtree emails saying that she agreed to the price we said

    She has the goods, you have texts......

    If she doesnt pay your only redress is via the civil courts. Or appealing to her face-to-face, if she really lives there.

    I would be sorely tempted to go round with an axe and repossess half the item of furniture. (But DO NOT actually do this or you will be arrested).

    Phew! just to let you know she has transferred. With an apology for keeping me waiting. So dave not Doh at all:) Sods law, you moan, it comes good.
