Perth PRI Parking

Does anyone know under what "law, statute etc." or agreement with NHS Scotland gives Smart parking the right to issue a penalty notice to someone who has parked in a Perth PRI car park while attending Perth PRI out-patients and did not get a ticket to put in their car?

Parking is free, supposedly.
Getting forgetful, if you think I've asked this before I probably have. :rotfl:

    There is no law or statute applicable to this. It's just a money-making scam designed to fool the uninformed into paying their unwarranted and unenforceable demands.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Its not a penalty and can be safely ignored as its just an unenforcable invoice from the local mob. Forget it, nothing will happen other than some toothless threats through the post.

    None whatsoever, this is a private firm relying on contract law only. It's not a fine.

    You must ignore it and all the usual 'scary letters' from Debt Recovery Plus and Zenith threatening Court (except if you actually get real small claims papers of course - but that won't happen). You could complain to Perth RI about this harassment - and if you are disabled then you may have a case to sue, certainly if it was an alleged 'overstay'.

    Does the sign on site actually say 'Town & City Parking Ltd (emphasis on the Ltd)? You can see from that other thread how to report them to the DVLA if the signs still say the other comany with a LTD on the end.

    And no-one in their right mind pays a fake PCN, not even if there had been a ticket on your car! And in Scotland there is no POPLA appeal so IGNORE.

    Car parking is free, so total loss to the landowner is zero.

    Smart are smart enough to know not to worry about doing court as their chances of success is zero.

    (Although poor Smart, they only ended up getting a penalty charge notice from the local council when they decided to park on DYLs outside one of their "managed" car-parks when doing the rounds, not so smart there)

    Ok I know not to pay the penalty what I really want to know is why do Smart parking think that they can put penalty notices on peoples cars?

    Did NHS Tayside give permission for them to do this or did Smart parking suggest this to NHS Tayside?

    I did email NHS Tayside about this but all I get from them is you need to provide details of the ticket before they will answer me.


    Although now that Smart parking have sent me a threatening letter because they got my details from DVLA, me with holding that information in case they send it to Smart parking now does not apply.

    You will probably find its the PFI contractor who made an agreement with Smart to predate on their car parks - The NHS Trust may had very little choice in the matter. Parking charges at all non-PFI hospitals in Scotland were abolished some time ago.

    Everyone gets the letters and it's POINTLESS replying when in Scotland, it's all a scam of junk mail. See here, similar thread and I just posted links about the letters:
