Incorrect Default date with Lloyds TSB

Hi
All 3 horrible defaults should be coming off this year. Years ago I went with a debt management company called Gregory & Pennington. Looking back on it my situation wasnt that bad, I wasnt in debt but work had messed up and I didn't get paid for 3 months. I panicked and went with this company and then my accounts defaulted.
The accounts all defaulted in 2007. I have shredded all my paperwork so I have no evidence of this. My Barclaycard default has just been removed and my Santander one will be off in a few months too. However Lloyds TSB has my default date down as 1 month before I made my final payment in 2010!!
I contacted Lloyds TSB and they said to get my credit agency to write to them. So I did and Experian wrote to them to get the date changed but they couldn't. Here is the reply I got back:

Lloyds TSB Bank PLC confirm they cannot amend/delete the entry at this time.

They have asked that you contact them directly with details of dispute.

I cannot change this information without their authorisation.

Their contact details are:

Customer Services
Lloyds Banking Group
BX1 1LT

You may want to provide documents to the company directly to support your comments as this can help them to resolve your dispute

So right now I'm not sure what to do as I have no evidence. It definitely defaulted in 2007 as all 3 accounts defaulted around the sane time. I really need this default to come off as these have ruined my life. I can't even open a bank account.

Complain in writing, signed for, to Lloyds informing them that you require the default date correcting. after that, you can refer to FOS but that can take months.

At the same time, but in a different envelope, send lloyds a Subject Access request. It will cost you £10 and should contain statements, account history that should include a default notice being sent. It will cost you £10 and they have 40 days to send the info.

Also have a read of this, which is the basis for complaint:

What kind of account was this? loan, OD or card?

Might be best if this was moved to the debt free wannabe board, but need a moderator to do that.

  • thanks so much for your reply. it's my first post. I wasn't sure where to post it and now I'm not sure how to move it to another board.

The default was on a loan from Lloyds TSB.

Yes, complain. Overdrafts are a bit funny but for a loan they shouldn't have waited until just before you cleared it. Thy are just trying to screw you for longer.

  • It's finally been removed! I managed to get hold of the original default letter dated in 2007 however they said I had to do it from 2008 even though I had proof??? It's taken this long to finally get it removed, los and lots of letters, emails and phone calls later. All very upsetting. I wish I could get compensation for all of this.

Wow, not far off two years to get this sorted. Good on you for your persistence. I think some companies just hope that you will give up.
