Friend got fired - any rights?

    There are two aspects to this……

    Less than a year and you can be fired for no reason

    But…..

    At any time if you are fired for discriminatory reasons (woman, black etc etc) AND can prove than you are protected.

    Also, if your employer has a disciplinary procedure which they invoke then they must implement it properly, action can be taken if they don’t.

    Moral of the story (for employers at least) if you want to sack someone who has been there for less than a year then just sack them, no explanation, no disciplinary procedure, just sack them.

    I would think the firm are in the right, I know the individuals rights increase after one year, I would imagine the firm has looked at her sickness levels and decided to let her go and look for someone who is more able to fulfil their contract and turn up ?

    Just an opinion, and I know as an employer I would do the same, business unfortunately is business and you are always looking for a stable workforce who will turn up, although obviously we all accept the odd illness

    The question the firm will look at, is how do they know that this is a short term blip and the sickness levels won't increase or attendance improve. I appreciate the difficult circumstances, but at the end of the day it is the firms decision based upon business.


    Interested to see what the legal guidance is and how the firm release her.
