Advice please - Eventim refusing to refund tickets

I brought some concert tickets via Eventim online. I put two tickets into my basket, but accidently put in 2 more, and checked out at the end without checking the total, so I was charged for 4 tickets when I only wanted to buy 2.

Immediately after making the purchase and realising my mistake I phoned Eventim and explained the mistake. I was astonished when the person I spoke to (who informed me she was the duty supervisor), told me that it was company policy to not refund tickets, even when the purchase was accidental.

Can anyone advise? I have never come across a company which has refused to refund before.

Is this covered by the Supply of Goods and Services act?

Any help or advice would be greatly appreciated.

    Yes it is.... but Sale of Goods & Services Act makes no provision for ordering goods by accident.

    Do they allow you to transfer tickets so you can sell them?

    Unfortunately, these will be classed as 'leisure services' and your statutory rights to cancel under Distance Selling Regulations do not apply:
    (2) Regulations 7 to 19(1) shall not apply to—
    (b)contracts for the provision of accommodation, transport, catering or leisure services, where the supplier undertakes, when the contract is concluded, to provide these services on a specific date or within a specific period.
    Right to cancel = Regulation 10

    Yes the service is covered by the act.
  • Thanks for the replies - the woman did say I could sell them on, but just more hassle on my part, as just want to go to the concert!

    So not worth making a complaint and push for a refund if will be considered part of a 'leisure' service?

    Even though there isn't a statutory right to a refund, still no harm in sending a letter appealing to their good nature. Despite technically them doing nothing wrong, it does seem to be very shoddy of them to refuse minutes after making the error IMO.

    Otherwise, not what you want to hear, but you will need to sell them and move on i'm afraid.

    If you dont get anywhere, perhaps some friends or family members would be interested? Or possible to take along two friends/family members as a birthday/anniversary treat?

    Lol, nice idea but I brought the tickets as a treat for my dad who's into Country and Western ( yeah I know, weird, but that's dads for you). I doubt any of my friends or family would be into that but worth a try!
