Just wished to share that, having followed the advice of numerous threads and posters on here to IGNORE everything from these "people" (I use the term loosely), I've heard nothing further since the turn of the year.
Again, as predicted on here, I received the following:
mid-Aug '12: Charge Notice £75 - £50 if paid within 14 days - (Highview)
Suspicions aroused by dodgy-looking paperwork.
end-Aug '12: Charge Notice Reminder £75 (Highview)
mid-Sept '12: Legal Action Pending £115 - 7 Days (Highview)
mid-Oct '12: First Letter £145.24 - 7 Days (Debt Recovery Plus)
end-Oct '12: Notice of Intended Litigation £145.24 +Costs of £102 & 8% County Court - I live in Scotland - interest (DR+)
Now smacking of desperation and references to County Court bamboozling.
early-Nov '12: Reduced Payment Offer £116.19 - 7 Days (DR+)
You now know their resolve is weakening and that all earlier threats were never going to happen. This is a last ditch attempt to extort money from you.
...Nothing further since.
So, just wanted to say thanks for the advice, I may have caved-in at some point along the way otherwise...or written to them to inform them I wasn't the driver.
And, to anyone else, receiving one of these "fines"...IGNORE.

Hi, hope u don't mind me posting, I have also just receieved 2nd letter from Debt collection Plus with Notice of intended Litigation. First letter from Town and City Parking then Smart Parking, I am about to write to them to say I wont be paying their demand for payment only because my husband is getting worried about baillifs coming, but there was never a pcn fixed to car (20/12/12) I had a broken arm so wasn't the driver and I also have the parkng ticket which was paid and displayed for time and date of alleged contravention. I also live in Scotland.

Oh jeez! For the love of GOD, don't write to or phone up a debt collection call centre - an office staffed by students who CANNOT deal with appeals and just try to make people pay money they don't owe - just because you have got one of their computerised standard letters that everyone gets!

Bailiffs can't just come round and - as you are in Scotland - nor can Sheriffs! This isn't an episode of 'repoman'!
There was no credit agreement, you didn't have a loan from the PPC and they haven't won a small claim against you have they? So for the love of God ask your OH to read all these links before you put pen to paper, which in Scotland is particularly pointless and plain daft, as they have no case against you AT ALL as you weren't driving.

The barrister says:
''Good. This is a private land fine. They are unenforceable. This is not a parking fine however it may look. These companies are private firms that have no more right to punish you for the manner of your parking than your neighbour does. Only the police or the local Council can do that.''
All you need to do between you is please grow a pair and put all the letters in a drawer marked 'scam'.

it also just shows what a scam all this is, they can't even get the legal situation in Scotland right lol When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I do admit to some initial anxiety but, this was alleviated by dropping in here from time to time for a bit of reassurance, plus...didn't want to upset Coupon-mad :eek:;)
And, the longer it goes on, the more desperate and inaccurate the letters become it's easier to ignore.0 -
I can also vouch that the advice works. I overstayed in a Pay & Display, once I'd offered them the actual losses (about £0.40!!!) as a gesture of goodwill, I ignored the entire threat-o-gram chain and eventually they went away. The game has changed slightly with POPLA, but the regulars on here are well on top of the game, more so than many so called legal professionals! I strongly recommend that you follow their advice - it will save you money and cost the scammers!!!0
