County Court Claim Form ref: Civil Enforcement Limited

Hi there, I hope you can assist me with some advice.

Firstly please let me know if I've posted to the wrong forum or thread, but ..

I have today received what looks to be a genuine Claim form from Northampton County Court with a label on the front with a number on it next to the Claim No. heading in the upper right corner and a stamp (round with crown symbol and saying Northampton County Court. To check if it's genuine on MCOL I need to enter both the claim number and my 'defence pack password' . I presume having just registered with MCOL that I will be emailed or posted a 'defence pack' ?

The claim relates to Civil Enforcement Limited saying my car was parked in a fast food restuarant car park for much longer than it should one evening in August 2011. Having followed the forum advice that these were one of the many scam PPC companies out there and to ignore all letters, I'm a bit concerned that the claim form does have a stamp and claim number rather than the blank fake ones described on the forum.

Could any of the experienced experts from the forum advise if I should be concerned and what my best next course of action is please ?

Yep, we can advise. There have been a few recent claims put forward speculatively by CE and a defence needs to be put in. A robust defence can be supplied for you (free) if you post a new topic on pepipoo:

    http://forums.pepipoo.com/index.php?showforum=60

Gan has written several CE defences for people on there so far and none have gone to a hearing (we expect CE to pull out of those cases properly defended, we suspect they are fishing for victims to fold or to get default wins over).

You need to acknowledge the claim and state you will be defending it, so you get 28 days to send in your defence. Pepipoo will help you so keep the thread over there 'bumped' by replying and asking when you need more help.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

1st course of action is to hop on over to pepipoo.com, there are a lot of these floating around at present and they have a few people concentrating on these. Don't accept help from anyone with less than 1000 posts, the experts have lots of experience and you will get real help there.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

Hi 1999jamie & welcome to MSE :hello:

I've moved your post out of the discussion topic and into a new thread.

    :)

    (also sent via PM)
  • Just to say I appreciate the replies received, and have added the issue as a topic on Pepipoo as you've suggested (and had a reply from Gan on that forum).

    Cheers again, Paul

You and about 50 others that we know of - and those are only the ones who have found their way on to the forums.

Get a new thread started on Pepipoo (in the Private Parking Tickets sub-forum), and the cavalry will soon be along.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Surely if they don't follow all these through to court, they should be in trouble for abuse of the court system.

That's whst we're all hoping. However, if enough people in receipt of these claims settle out of court or fail to submit a defence (resulting in s default judgement), CEL win on the numbers and may also escape a Vexatious Litigant charge, more's the pity.
