OP - I do feel for you, it's a great shame for you; but the employer needs the role to be done and there is no firm date at all for your return. Of course it is not your fault that you have had to wait for a specialist's appointment - but your employer sees it as not their fault either. Also, although I understand totally that you believe the doctor was wrong to prescribe you those other drugs, the employer will see it as failing to follow medical advice: which in a LTS case is a big no no.

Following dismissal notice and attending an appeal with a union rep, i have been dismissed on attendance grounds. I lost the appeal and really didnt feel that i had real support from the union rep. I was told of the decision within minutes of the meeting and afterwards i asked my union rep, what now....expecting a tribunal case (prior to meeting she showed me a form regarding tribunals) but she turned round and said...we can do nothing as they will laugh at us! I have a condition that is covered by the new equalities act (under disabilities) but this seemed to make no difference. My main problem was the travelling to the main office; they previously agreed that i could work 2-3 days between home and local office and 2-3 days in the main office. Not sure if i should take the union reps word that i have no case or should i look for a no win no fee solicitor? I was waiting for an appointment to come through with a neurosurgeon which i now have...all too late. Any advice please?0

If you have home insurance, have you checked that, as you may be covered for legal help for employment issues.
