If you have it - or can point me to it, I would love the about the prosecution for the 40 day rule. There is another letter, going off soon to my mate Adrian Whalley, telling him I aint going to be fobbed off by the liars within the company. I cant find anything on Citi or Barcalycard having successful claims. I even pointed out to him, after he said the defence was based on costs (thats probably the only bit thats true) so iasked him they would defend on £70 - I've got to submit to find out!!! (and I cant really afford the court fees, although I know you get these back)
I cant find any evidence to this on the internet at the mo, I suggest you call the ICO
I have a document upholding my complaint about the 40 day rule, but not that willing to share it as its a PDF with my name & address on.
there are lots of peple on CAG who have proescuted under the DPA- do a search in thier data protection board.:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

No Problem re letter and address - understand that. Thanks for the tip re CAGNo Longer works for MBNA as of August 2010 - redundancy money will be nice though.

I took Barclaycard to Court over non-compliance with my Subject Access Request demanding £200 damages and my court costs.
They put in a defence.
After readin it and when I finally stopped laughing and had picked myself up off the floor,(it relied totally on the microfish scam, ruled against by the ICO) I wrote to Adrian Ruffhead (Bcard legal exec) and emailed their "defence" to the Information Commisioner's Office.
A day or so later, Adrian emailed me. For some reason he was very keen to throw money at me to make me go away.
