Interesting conversation with B'card.......

I just phoned up barclaycard in response to a complaint I put in about their - shall we say service (and OFT fees)

Anyway, apparently, The ICO has given them some leeway and the dont HAVE to respond within the forty days (I'm going to ask them to clarify this) Also, I mentioned the fact their representative challenged me to take them to court - so this bloke said to me the rep was right in saying it as that was now my only other option - when I asked if they would bother to defend, I was told possibly - and that they had recently successfully defended a claim (im sure thats not right) he also claimed that other banks had too (excluding the recent lloyds case) Im sure this isnt the case either.

Anyone else heard of Barclaycard or Citi (was mentioned in call) being successful in court?
No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

    actually this is BS

    the ICO are prosecuting them for ignioring the 40 day rule.

    my complaint to the ICo on this was upheld last year and me and a loads of other people started the ICOs a major investigation which upheld that barlcaycard was acting illeegally.

    Ive got the email somewhere if you are desperate to find out,. otherwuise I recommend takign them to court for failiure udner the DPA.

    If you have it - or can point me to it, I would love the about the prosecution for the 40 day rule. There is another letter, going off soon to my mate Adrian Whalley, telling him I aint going to be fobbed off by the liars within the company. I cant find anything on Citi or Barcalycard having successful claims. I even pointed out to him, after he said the defence was based on costs (thats probably the only bit thats true) so iasked him they would defend on £70 - I've got to submit to find out!!! (and I cant really afford the court fees, although I know you get these back)

    Do you mean Citicards?

    Citicards have successfully defended 1 case in Northern Ireland where the rules are a bit different to here. They have produced a very basic looking calculation which says that they have costs of £12.88, which they have lowered to £12 in line with the OFT report.

    Citi are refunding to most customers the difference between £25 and £12.00 and after that they are attending court.

    A couple of judges have said that if that is what Citi says it costs then it must be correct.

    However, at least 7 cases that I know of (me being one of them) have ordered full disclosure and a full breakdown of how charges are calculated and also the costs relevant to the relevant year of the particular customer.

    Citi are ignoring all these orders. They had a case inthe Mercantile and ignored the order and paid up.

    They have had their defence struck out with me and they STILL haven't paid up. They are trying every trick in the book, but slowly are becoming unstuck. They have had the bailiffs in once and then paid up. It's my turn now!

    Yes, CitiCards CitiBank, all boils down to the same company. I too have asked barclaycard for the breakdown of the information of how charges are arrived at - not suprisingly they didnt supply it - I wonder why (although they did say they would present it to a judge if needed - so why havnt they already)

    Only that they gave me three months back, and stated it was up to me to check the policy. Gonna write back - probably this weekend, and ask to look again citing loads of rubbish over how it should be sold and fsa guidelines etc

    i know they offered you money (like they did with me) but i thought you were owed a claim like me?

    I dont know what mine will be as my barclays stuff goes to my parents in rochdale and havent been there for a month but going tomorrow so will see if i have head anything

    I was told I could possibly claim, but the insurance dept had no knowledge of the policy.

    well if you didnt have a policy then you were paying for naff all so they cant have possibly charged you.

    Get on their case - you should have a strong case if they have charged you for a policy that doesnt exist

  • Have a look at penaltychargesforum.co.uk there is someone there who has recently been suprised by a bank defence, the Judge was suprised too so the case has been postponed. This is citibank and it is the 3rd time they have defended, PCF are raising funds to hire a Barrister to help the poor guy who has landed up with a defended case.
