G24 Parking Fine

Hey Guys,

I appreciate the sticky threads but I'm still a little confused on how to proceed here, and seeing old posts from varying results on google make me unsure of how to deal with this fine a friend has received.

I went to my local town centre with a friend, after 2 hours I went on to somewhere else in a taxi, my friend waited with me as I'm in a wheelchair and as it was raining down hard I waited undercover until they could flag down a black cab, after which my friend drove home, queue 3 weeks later and they receive a G24 'notice' of the car driving in / out and overstaying by 15 minutes, which of course wouldn't have happened if I could've got a taxi right away and not had to wait causing friend to overstay.

They want to ring them to explain this, but are they to be taken seriously, or as some other threads suggest ignore all their incoming letters...

    Absolutely NO POINT ever phoning up a fake PCN scam company! :eek:

    What does your friend think a private profit-making company is actually going to say? He seems to be under the illusion that this is a real ticket with a normal company prepared to consider appeals. It's NOT.

    The only way to possibly get this cancelled face to face is in the shop by complaining to the Manager. Worth a try but if that doesn't work, never fear!

    So you arrived in the car with your friend, you were his passenger, right?

    So as a disabled person you are allowed more time for the car you were a passenger in, to park whilst you carry out your shopping and other business associated with the visit.

    He was the registered keeper/driver so he will need to appeal IN WRITING first to G24, saying that his passenger is disabled (no need to go into further detail - no need to mention waiting for the taxi, don't complicate the matter).

    As I said above, a disabled person you are legally allowed longer to shop and go about your daily life:

    Take a copy of your Blue Badge if you have one. Give that to your friend and advise him to word his first appeal like this (less rude if he prefers!):



    ''PCN number xxxxxxx car reg xxxxxxx

    Re the above 'ticket' I am writing to inform you that my passenger is disabled so we were legally allowed longer to park than able bodied visitors.

    Here (attached) is a copy of the passenger's Blue Badge that your flawed but money-making camera system couldn't see; so the fake PCN is legally unenforceable of course.

    Parking Companies, Supermarkets, Landowners, Managing Agents and Retail Parks are required to be aware of this issue (an inherent flaw with camera systems in car parks) because it is not only their legal duty to comply with the Equality Act and make 'reasonable adjustments' for disabled visitors, but the matter has been the subject of press articles such as this:

    I will happily point this out in a POPLA appeal if you want to fund it rather than cancel your little scam immediately. My requirements for you to produce to POPLA will include (but not be limited to):

    - a copy of your site agreement and contract for that car park
    - copies of all logs of the maintenance, faults reported, and any checks of the camera at that car park in the preceding 12 months
    - a copy of all minutes of meetings where 'reasonable adjustments' for disabled visitors have been discussed with your client, regarding this car park
    - a copy of all information issued to you by the BPA regarding making 'reasonable adjustments' under the Equality Act 2010 (not just the Code of Practice)
    - contemporaneous photos of the wording of the signs at that car park
    - a map of where the signs are at that car park
    - an exact transcript of the wording of the signs at that car park
    - a contemporaneous photo of all signs placed at the disabled bays in that car park.

    Your choice...POPLA appeal or cancel the fake PCN. I am sure you realise your made-up t&cs and arbitrary time limit cannot circumvent the Equality Act 2010.

    For the avoidance of doubt, I deny any debt to you. Any correspondence other than a rejection with a POPLA code so you can waste your money, or of course an apology and confirmation that you have cancelled the fake PCN, will be treated as harassment under the Protection From Harassment Act 1997 and the Equality Act 2010.

    Take formal notice that if this fake PCN is not cancelled immediately, I WILL take this to POPLA at your expense and I may also take legal action without further notice against both G24 and [{shop/retail park/landowner's name}] who are jointly and severally liable for the harassment and Equality Act breaches of you, their agent.''


    PRINT NAME (do not sign normal signature, scammers do not need it).




    Enclose a copy of your Blue Badge if you have one (you aren't obliged to have one of course, and you are still allowed longer to shop!) and a printout of this BBC article:

    Read it and you will see that they have actually broken the law! The only difference being that after that article, the old DDA was replaced by the Equality Act 2010.
