    Yes I did - there are not many posts about success but I was hoping someone else would have had success with the small claim court getting money from an executor and let me know.

    Which is the Deaths, Wills and Probate board.

    This doesn't appear to be either a consumer rights issue or a small claims success then you might get more response on that board.

    Thanks for that - I am new to posting on forums - as you can tell!. I was hoping that selling shares & not distributing the proceeds might be covered by small claims, as a service, & someone would have had success (or failure using the court) but I will post on the other board.

    Small claims is a long process and if your proceed to use bailiffs for example they only make one visit and you have to keep chasing to bailiffs to make further visits.

    You may get success but you'll be waiting a while.. If you are using this route make sure you have all your evidence ready,

    FWIW, if the claim value is £1200 (plus claim costs) then you'd be able to elevate this to High Court Enforcement Officers (think "The Sheriffs Are Coming") as they have much greater powers to collect the debt.

    Just wanted to thank everyone for their replies.
    I checked the Government website - make a court claim for money- & wrote to my sister detailing when she said she had sent paperwork to sell shares & how many times I had contacted her & I gave her 14 days or I would go to Court.
    The same day she received the letter she phoned to say she had just received payment (!) & after a few expletives she sent the money next day!! Oh and as I told her the Court would require proof of how much she received for the shares it turns out there were more than she had told me & I got almost double the amount I expected. So although I didn't go to Court it is a kind of success via the small claims court.

    I recently started college on a course that was described on their website as full time. My wife is in full time education too. This would make us a council tax exempt household. When I approached the organisation for a confirmation letter for the council they gave me a letter detailing the number of hours and refuse to refer to it in terms of full or part time. The council will not accept this. I complained to the organisation and they have simple repeated that they do not refer to the course in terms of full and part time even though I've shown them clear evidence they did. As a household we are now unexpectedly liable for 75% of the council tax. On the day I enrolled the lady refered to it as a full time course but theres no recording of that obviously. Part of my consideration in starting the course was in knowing that we would be council tax exempt. Do I have any recourse in the small claims court?

    Any thoughts would be appreciated.
