Hello, I have a situation which I think is best suited for small claims court, but I have a lack of information.Any ideas.... as I believe I need his name and confirmation of the company address before I can write to him, giving notice on intention to send in the small claims form
You'll probably find your answers there.
if you want more detail, there is a link in that Small Claims Court Guide to the Money Claim Online website.0 -
thanks
I have read both the guide and the money claim website, - the issue I have is getting full details of the person I have an issue with.
which I would assume still falls under this threadsmile --- it makes people wonder what you are up to....

Hello, I have a situation which I think is best suited for small claims court, but I have a lack of information
We hired a hot tub for a week, full payment for the hire
which include
hot tub hire
gazebo hire
deposit
was paid end of September 2013, we received the hot tub on 1st November. We did not receive the Gazebo as the suppliers one was torn, also the extension lead he had supplied was faulty - meaning I had to arrange an alternative .
when we originally booked the hire, we were told that the refund would be 'posted through the letterbox' if we werent at home when the hot tub was collected, we were at home and the chap collecting didnt know anything about the deposit. the hot tub was collected on 7th November.
I have since spoken to the supplier and been told that If I gave him my bank account details he would arrange immediate bank payment this was on 11th November, plus he would include an additional £20 compensation. - so £100 due.
I waited and checked my bank account daily, also phoning him daily. On the 14th he said he would check with his bank...... on 15th he was unavailable.
on 18th I spoke to him at 16:50, to which he said send him a paypal money request, which I did, I then travelled home by train, when I got of the train I checked my papypal account no money - I phoned him and was told, he would deal with after putting kids to bed, so approx 2 hours - but I would have it by the time I got up in the morning.
Today no money - phoned no answer.
the issue is I dont have his surname - although I think I have found it (he is a webpage designer and had put a surname on one of his test pages - which he has released into the internet - doh).
I have tried tracking the company down via companies house and get an office address but listed under another companies name.... so I a little perplexed.
Any ideas.... as I believe I need his name and confirmation of the company address before I can write to him, giving notice on intention to send in the small claims formthanks

If you don't know who you entered into a contract with you are stuck I'm afraid
You mention an individual and you mention a company.
If your contract was with an individual, then you do need to know their name & address if you wish to start a claim.
If a company, then you can forget all about any individual. As long as you have the company name (or preferably the company number as then there will be no possible confusion with name changes, companies of similar names, etc) then you can find their registered address on the CH website. Any notice, including a LBA or a claim itself can be sent to the company at their registered address.0 -
Hi All
I am wondering if I can take my 'ex' to the small claims court to get money back that he owes to me.
Money was lent for car repairs, various other things whilst he was waiting to be paid by companies he worked for as a self employed contractor. Totals about £3,500 - how stupid was I!!!
Still, we have split and he keeps saying he will pay me back but in nearly 6 months all I have is £100.
Can I take him to small claims to get this money back? or do I have to forget about it?
Any advice would be greatly received!!0 -

You can take him to court.
Remember, you will need proof of these debts.

Having looked around for a supercar hire company, I found that thePrestige Car Club looked about the best...however I wish I hadn't bothered now.
I booked a Range Rover Vogue SE for my 10th Wedding anniversary totake my wife away for the weekend. On the day it was supposed to be delivered,I received a text message from {Edited by Forum Team} (Managing Director) to say thevehicle had been damaged by the previous customer the day before and that Iwould have a Mercedes C63 AMG Black Edition instead. When the car arrived - 3hours late, it was only the normal Mercedes C63 AMG. The car was extremelydirty, having been driven up from London to the north-west and the driveroffered me £15 for me to take the car to be cleaned. I refused and made themtake it to be cleaned.
The car however was fine and very enjoyable and I was pleased withit in the end.
However 7 weeks after returning the car in perfect order, andsigned by the driver collecting it to say there was no damage etc, I am stillwaiting for my deposit to be refunded. £1000.00
Despite many calls to the owner of the company and emails andtexts, he keeps promising that the payment has been processed when it obviouslyhasn't. I am still waiting today for my refund.
I have researched the internet and discovered that this person /company has many complaints against them where money is not being refunded andpeople have given up and wrote it off due to the costs to make a legal claim. There are also reports that Surrey police are trying to put a case together andthat {Edited by Forum Team} has already been summoned to appear in court for similaroffenses.
