Lost my claim

Well after 1'st complaining back in September about the £5000 worth of bank charges over the past years I was offered £100 from Halifax as a gesture of good will.I said no thanks and took my complaint to the ombudsman where they said I have no Argument and referred to the 2009 ruling the banks won.
Back in 2009 I was made redundant and had no proper work I started agency work to get buy. We had HALIFAX total mortgage protection for what we thought covered our monthly payments which should of paid out the cost of the mortgage and some more on the top this was refused as I was working over 16 hrs p/w as we couldn't survive on the dole and signing on we made a successful claim against being mis-sold the policy and got all the payments back I just can't understand the F/O decision that we were not entitled to the charges back after getting snowballed with charges that put us in financial hardship with having to find the money to pay the mortgage that the policy should have paid and to pay all the other priority bills the Halifax said they will not move from the £100 offer don't really think the F/O has looked into my complaint fully.

You've rather missed the boat with this complaint. No Bank will now consider a charge complaint unless it complies with their hardship criteria and is typically from a period within the last six months.
You really should have accepted the £100 goodwill offer, I doubt it's still on the table now that you've complained to FOS.0 -

Which was always the likely income. After all, the banks won the court case and the FOS do state they wont take complaint on about unfair bank charges.I just can't understand the F/O decision that we were not entitled to the charges back after getting snowballed with charges that put us in financial hardship
Are you currently in financial hardship? You cannot put in retrospective requests to refund. It has to be current. Plus, many banks will only look at the last 6 months when viewing hardship cases.
Also, you say you said you were complaining. Was your complaint about unfair charges or a request for consideration under current hardship guidelines?Halifax said they will not move from the £100 offer don't really think the F/O has looked into my complaint fully.
The FOS has no remit on this front as the courts have ruled.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. Thanks for the reply. I took the point of complaining as I had a refund for the mortgage ppi but still had to pay all the charges for when we were in hardship and the constant snowballing of charges at the time . I now know that historic claims won't be looked at after 20 years with the bank I am now going to bank some where else.0
