Bump in the car on a private cul de sac

hello.
my sisters neighbour reversed into a car in a cul de sac the car had quickly pulled into the road dropped a child off but the cul de sac is a private road. i assume he has to pay up. does the issue of it being a cul de sac come into it?

    Assuming he has valid insurance then there is no difference at all.

    If there was a problem with his insurance then it would need to be looked into in more detail to see if his insurers were the RTA insurers or not. That doesnt change his responsibility to pay, just his insurers

    No.

    Assuming public access to the road is permitted.

    None at all, there is a host of case law of people hitting things that shouldnt be where they are (eg lampposts 3' into the road) and it was not any impact on liability. An object is there to be seen and avoided

  • One of the first things I learnt when I worked in insurance - just because something shouldn't be there, you don't have a God-given right to hit it. Lots of things end up in the wrong place - cars break down in the outside lane of the motorway, small children run out into roads, trees fall over, and (the specific case that I was faced with) people park on roundabouts (really!).
    Whatever it is, it's your fault if you hit it (apart from, if memory serves, unlit skips at night...)
    No longer a spouse, or trailing, but MSE won't allow me to change my username...
