Bank charge letters sent to previous address

Are bank charges a legitimate claim by the bank (Barclays) when they have sent the warning letters to my previous address that I moved from in August 2009. The bank statements have always been sent to my new address from the time of moving into the new property.
I understand that under contract law if a penalty or warning notice isn't issued or properly served the charge cannot be applied.
There is also the aspect that the bank has made my identity vulnerable to being stolen with the possibility that persons unknown could be accessing my bank account without my knowledge.
What is the best way of proceeding on this issue?

Whilst bad service, it does not make the bank charges wrong. They are because of an event unrelated to your address.I understand that under contract law if a penalty or warning notice isn't issued or properly served the charge cannot be applied.
