Absent parent has given CSA false payslips

    RAS your totally wrong no-one has a right to take kids out of the country without mutual agreement, not even for holidays, admittedly i only read last post and was shocked so posted correct reply
  • If the case has been set up in the last 5 weeks, and there are 3 children, it will be on the new 2012 scheme.
  • The CSA will say that theirs IS the priority bill ! They will take nothing else into consideration just a straight 25% of his wages for your children.If he gets into arrears they can issue a DEO(deduction of earnings) when they can take up to 40% of his wages.It's not going to happen overnight though they took 14 months to tell us that the pwc had contacted them!

    In which case he will have been assessed on last year's gross income as declared to HMRC won't he?

    So wage slips won't come into it.

    It depends on when the case was set up - I know that they widened the criteria for 2012 scheme applicants but I'm not sure of the date off the top of my head.

    If it IS 2012 scheme then the figure used would indeed be supplied by HMRC - if there was no info held then they would look to wage slips, or if the NRP said that they were earning and income at least 25% different to what the HMRC figures were.

    He has told me he will never pay the CSA a penny towards our children and that he will make out invoices to say he has priority bills to pay even though he has a really well paid job.

    He can try but he won't succeed as the CSA ignore ALL outgoings so it really won't make a blind bit of difference.

    He won't be challenged on leaving the country providing he has the passports for the kids so who will know OP disagrees? Once he is gone you are left with a long slog on a child abduction case under the Hague convention (if he goes to a country that signed up). Get a prohibitive steps order and get in touch with the passport office to prevent passports being issued. It will save a lot of worry and trouble if you are sure he is a flight risk. You will need to convince a judge he is a flight risk.

    I think opinions should be judged of by their influences and effects, and if a man holds none that tend to make him less virtuous or more vicious, it may be concluded that he holds none that are dangerous; which I hope is the case with me.
  • Thanks to all who have recently posted on my thread.

    To update everyone, my husband was totally non compliant with the CSA, the wage slips he managed to convince the CSA that he thought they wanted his DAILY wage instead of his weekly wage, consequently weeks were lost with the CSA having to write to his employer for confirmation.

    The CSA made so many blunders - too many to mention so MP involved and I even wrote to David Cameron and one of his side kicks also got involved. According to CSA, two employees were dismissed over missed opportunities whilst dealing with non compliant husband.

    Eventually they put a DEO on his wages and 40% off the arrears and after almost 6 months, I've only recently received my first payment. Husband is now threatening to leave his job, which would not surprise me. He's made no attempt to see his kids and as legal aid is no longer in place, I cannot afford to see a solicitor. At least the money has gone towards the children's school clothing, shoes and baby clothing, but I wont hold my breath that he will continue with his employment.

    Thanks for updating us sounds like a good result! I'm glad you got CS sorted even though he is being !!!!!! and threatening to leave his job....just see what happens.

    Did you ever do anything about the abduction situation?
