Hi all.

I have a problem. I was contacted by bcw a couple of months ago regarding a debt under £300. They claimed it was mine. I thought it was fishy as my name was spelt wrong on the correspondence and I had never had a loan with the company mentioned. Also the loan was taken out in 2007 at a certian address Ihad moved out of it in 2005. I contacted them over the phone to discuss this last month. They told me it was my debt they were very unhelpful as well very aggresive. I refused to acknowledge as such.

The next thing I know i check my credit file and there is a default there bcw have put on last month for the said amount with a default date of 2010. I have found out who took the loan out in my name (family member) and I want to clear the default off my credit report. I was wondering how to do this without involving the police. The mentioned family member is willing to talk to the companies involved to explain what happened to try and help me get rid of the default. It is a horrible situation that i need some help with any suggestions would be gratefully recieved.

    I don't think you'll get anywhere at all unless you are prepared to involve the police.

    If you think about it, if the police don't have to be involved, anyone could ask for defaults to be removed saying a family member took out the loan in their name couldn't they ?

    Unless you are willing to report it as fraud, I can't see why bcw should believe you.

  • I will obviously involve the police but as a last resort. I was hoping there was was something anything i could do first to try and involve that outcome.

    I suppose the relative could write to them admitting what they had done and promising to pay and take on liability. Long shot though. Even that may be rejected.

    There's no chance whatsoever of this being accepted. The loan is in the OP's name, they're liable for the repayments, end of. Unless they report it to the police.

    Surely the way to resolve this is to get the family member to pay it? With the account then settled, you then contact the ICO to state tat the info on your file is incorrect and you require the removal of he misleading default.

    Without proof of fraud though, the information on the credit file isn't incorrect is it ?

    If defaulted in 2007 then a default date of 2010 may be incorrect.

    Hard to say though, as we don't know if the relative made payments on the debt, and if they did how long they carried on for before defaulting?
