Armtrac Security Services - Falmouth Maritime Museum

Hi everyone, this is my first time posting. I've been browsing for a few years.

Firstly apologies if you've heard this all before but I just wanted to throw this case out to see what you guys thought.

We were parking in the Maritime Museum in Falmouth, I paid for my ticket, and placed it correctly in the car.

We went into town came back and then released we had a Parking Charge Notice, obviously we were surprised as we had paid and displayed and we had about 2 hours left on our ticket.

We appealed and as you can all guess the appeal was unsuccessful...

Appeal email: (for reference I'm the Husband)

Hello,

Today we parked at the Maritime Museum Car Park in Falmouth at around 12pm and paid for over 3 hours.

On return we were surprised to find that we had received a parking ticket and then we noticed the ticket had flipped over whilst still remaining on the dash. Whilst we totally understand why a parking charge notice was given, it would be greatly appreciated if the charge could be rescinded as we had paid for our time.

We can only assume whilst getting our daughter's pushchair out of the boot of the car the wind must have blown the ticket over, as my husband can specifically recall placing the ticket the correct way up on the dashboard of the car.

I have attached scans of both our original parking ticket and the Parking Charge Notice.


The reply has some lovely comments in it such as...

"It is the drivers responsibility to ensure that a pay and display ticket is displayed correctly and you have admitted in your appeal letter that you did not do this."

Erm, no we didn't.

Anyway given our appeal email, should I follow the advice everyone seems to give out and ignore the ticket and likely follow up letters?

I kinda want to get in touch and rinse them for dishing out tickets that aren't fit for purpose. Where's the adhesive!

    Thanks, I had looked at a bunch of them, I just wondered if given the specifics I should follow suit?

    I think I know the answer, but I guess I just wanted a bit of reassurance.

    Well on their rejection of your appeal did they supply you with a popla verification code so you can appeal independently ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Well you should use it then and appeal to them, but you need a defence drawn up, don't do it on your own, we can help and so can the guys over on https://www.pepipoo.com so I suggest you post there as well, mention you have a popla code straight off it will save time.

    That's old advice from more than 6 months ago. On the current forum you'll see lots of stuff about POPLA appeals, NOT ignoring that chance where the PPC is an AOS member like in this case, and also not just firing off another 'soft' appeal to POPLA as that really won't cut it!

    If you want to post your draft here for comments and advice before you send it off to POPLA please do, as we are keen to help everyone who posts here to win their POPLA appeals. I reckon it's possible. It's the soft appeals that lose (sadly).

    I'm in the exact same boat muzak.
    How far have you got with your popla letter?
    I was ticketed at the start of may, in the same carpark for the same reason. I have retained my ticket for inspection but they won't back down on the £100 charge as it wasn't displayed correctly!
