To clarify, nobody made ANY reference to the landlord being given the deposit by the Agent, NOR that the LL MIGHT POSSIBLY have been self-managing ...The second half of my post assumed that the agent had passed the deposit to the landlord at the start of the tenancy. This is normal behaviou if the landlord is managing the property himself and using an agent only to find a tenant.
... Indeed, the OP clearly stated that the AGENT informed her that the AGENT had given the deposit to the Creditors.
I think you have therefore made several unwarranted assumptions ...
Furthermore, IF the AGENTS have given the Tenant a receipt for the Deposit, then they remain legally liable irrespective of who they may have unilaterally decided to give money to ... IF the Agent gave it to the Landlord OR Creditor, then the Tenant's claim is against the Agent, and the Agent must then in turn seek to recover that money from the Landlord/Creditor they gave it to.Democracy is two wolves and a lamb voting on what to have for lunch.

i think if you have the time to read EagerLearners long long thread - all your questions will be answered. She had a deposit with-held and is suing the landlord. It is my understanding that the owner is ultimately responsible - so even if the agent steals the deposit, the landlord is still legally responsible for its return to the tenant.0
