Do I have a criminal record

    It doesn't sound like a criminal record to me. I think these forms usually ask if you have a conviction or a caution - this sounds like neither. It sounds on the same level as a speeding ticket - most employers are not interested in this sort of offence so don't worry.

    I'd just say nothing, I don't think you have anything to worry about.

    An employer doesnt have to give any reference and there are employers who have given people negative references but you have a right to see and challenge a reference if you dont think its accurate.
  • I think you need to stop worrying, its not going to come up.Just say no to the question about convictions/ and cautions.

    I'm talking myself into this negative state of mind...I'm not going to say anything and if it does come up I shall say..." I was never aware that I had a criminal record and was always under the impression that I had broken a bylaw not a criminal law as I was led to believe at the time"...... And that is pretty much the truth .

    If it does come up, I don't think it bears any relevance to the job I'm going for or the person I am today and I hope that they will see that. I'm going to think along those lines.

    Ignorance is not an excuse. I would check to see if you have a criminal record before completing the form.

    I deal with this type of situation a lot in my job. It may help others to know that HR tend to do the following:

    1. Check what the DBS details - what the conviction/caution was for, when it occurred and whether there are any patterns
    2. Check the application form to see if it was disclosed
    3. If disclosed, do a risk assessment based on the role. I would speak to the recruiting manager to check on details of the job. I would be concerned about a theft/fraud conviction for nursing roles in the community for instance.
    4. If not disclosed, then I ask the recruiting manager to contact the individual to discuss the results of the DBS and why it was not disclosed. Again it comes back to making a risk assessment.
    5. If everything checks out then we will let the recruiting manager/recruitment team it is ok to progress.

    I would say that generally speaking fare dodging would be relevant to the care job if you are handling people's money, because it is a type of fraud and raises questions about your honesty. However as it was a one off incident and so long ago, I really don't think it's going to impact on the job at all if it does come up.
    So in that respect, I would mention it in passing along the lines of what you've already said, that it was a one-off incident 30 years ago, and that you don't believe you have a criminal conviction, but you're telling them just in case.

    Pedant alert - it's could have, not could of.

    Many convictions will be spent after a certain amount of time although some stay on file for life, but seriously, all this worry about skipping a train fare 30 years ago.

    I wouldnt be disclosing it. You got fined, you paid the fine, it was 30 years ago. I dont think paying a fine for skipping a train fare would give you a criminal record.

    Oh for goodness sake, how does that make someone not able to handle people's money, not paying a fare. It was 30 years ago, she made a mistake, she paid the fine and its done and dusted.

    Yes its technically breaking the law but not paying a train fare and getting caught and the length of time thats passed since doesnt make someone a criminal, she was fined and she paid the fine, I would be very surprised if that would show up on any criminal records check.

    And if it did and you werent aware you could explain the circumstances, its really not worth all this stress and worry over.

    It is not a high security job so even if there would be some kind of records (unlikely) you are probably fine.
