ParkingEye Parking Charge Notice

Hey Guys, I need some advice. I have received this letter from Parking Eye on 4th April 2013 for an overstay of 49 minutes at Aldi. I send them a letter of appeal stating my reasons for overstaying my stay. But I haven't heard from them regarding my appeal and they sent me another letter today. I am not sure what should I do as I don't want to get involved with CCJs and other matters.
Please advice!!!

    But I already acknowledged their letter and wrote an email appealing against their decision providing all the relevant information and a receipt copy of Aldi store as well.

    The advice to ignore charges from Private Parking Companies may have worked well in the past but the best advice nowadays is to appeal. Now that there is POPLA as an "independent" appeals process it is possible to stop this harassment going any further. We are hearing reports of people getting court papers a year or more after the "offence" not to mention the worry & hassle of being chased by debt collectors. It's far better to stop the whole process in its tracks as a carefully worded appeal to POPLA is all but guaranteed to win once a couple of crucial questions are asked that the PPC will refuse to answer & thus the case will be won by default. They will refuse to answer any question on their right to levy parking charges or provide details of the contract with the landowner that gives them the right to levy charges &/or pursue the "offenders" in court. This is either because they don't have any such right & their threats are just bluster or that the contracts have clauses that are embarrassing to the landowner e.g. they get a backhander on each charge or that the PPC is expressly forbidden to take the driver to court.

    A real danger is that some people take the "Ignore" advice too literally & wind up ignoring court papers & get a judgement against them by default. We have seen quite a few of these here & on PePiPoo. It's far better to hit them hard at POPLA & put an end to the business.

    Incidentally I doubt that Parking Eye are interested in your reasons for overstaying however justified as they are only interested in charging you as they have no other source of income so allowing an appeal means they are out of pocket. Complain to Aldi & get them to cancel the charge. They are the organ grinder so deal with them rather than the monkey. If that fails then a well worded case for POPLA will knock it on the head but you will need to go & get here for a better class of advice on how to word your appeal http://forums.pepipoo.com/index.php?act=SF&s=&f=60
  • Mitigating circumstances, as indicated, are a waste of time. The only decent "appeal" to the challenge the whole basis of their charge.

    Anyway, what did that "other letter" say? Was it a response to your appeal, or just another demand for money? When was your appeal sent in, and when was PE's latest letter sent? They have 35 days from your appeal to reject your appeal and provide you with a POPLA code. They often forget the latter, or come up with stalling tactics. Ignore everything unless it's a POPLA code.

    If they don't provide one in time, it's game over for them, and all the intimidation will be of even less worth than it was before (which was always pretty near zero).

    Most of all, don't pay, and don't worry.

    So (unless they write accepting your appeal and receipt*) you wait for their standard rejection letter and then - if this was in England/Wales - you appeal to POPLA but in a much more strongly-worded way than a normal 'soft' appeal! As you will find discussed on lots of other Parking Eye threads when ytou read them - this forum is full of them! Do post back here when you get the acceptance or rejection of your appeal, and DO NOT prompt them.

    Hopefully now you are on this forum you realise this is all a scam - but also that you can get help to appeal it well at POPLA. DO NOT fire off any old appeal when it comes to POPLA stage as you need more legal points than you would think. A soft appeal doesn't win, as shown on the POPLA decisions thread.
