Bankrupt company not repayed our money but paid on CC!

Not sure if anyone can advise us what direction to take with this so any help would be greatly appreciated.

So, whilst going through our six years worth of credit card statements my bf suddenly said to me,, in June 2009 he paid a deposit of £500 on his barclaycard as a holding deposit for a car. He says - there should be a refund for that a few days later....... Nope!!

So he rings the company in question who say that company went bankrupt in 2010..... They are just trading under a slightly different name!! They were very rude and unhelpful so we thought as we paid on barclaycard the credit card insurers us for this type of loss?

We rang barclaycard and they say they need proof the company in question should of refunded it.

Surely this company has to keep records for 7yrs is it - as an audit trail or is this not the case when a company goes bankrupt?

Any help?? :-(

    I fear you have a case but if you can't prove it then you are going nowhere with this because of the timescale.
    A limited company is its own legal entity - if it has been struck off at companies house who will you enforce the 7year rule against?

    Now if you had your paperwork showing the deposit as refundable if the transaction does not proceed I think you would be able to go ahead with a claim...?

    I would say he needs more than just that - he would also need to be able to prove that the transaction did not proceed. If the muppet doesn't realise for 4 years that he didn't get the refund he was promised then I would say that the likelihood of him having any proof is slim to none.
