    In the fees part of the contract it says that fees are payable on exchange of contract.
    It says we will be liable to pay commission if at anytime unconditional contracts for the sale are exchanged, with a buyer introduced by us during the period of our sole agency or with whom we had negotiations about the property during that period or with a buyer introduced by another agent during that period

    Sounds OK, but sometimes there is a specific clause relating to withdrawal by the vendor. If that were present, it would probably relate to a percentage of the usual fee, not the full amount.
  • The only part where is says anything about cancellation fees states that if we cancel the contract within 7 days we will be liable for fees of up to £200.
    I will call them tomorrow and explain that I'm going to view 2 properties and will let them know after the weekend.
    I've got 2 more viewing tomorrow I'm dreading it I just want to stop it all now!

    The fee is usually paid when the sale is completed it would not be payable now. If you were to pull out and sell to this buyer at a later point you, even if you had changed EAs you would still owe them as they introduced them

    However, if you pull out now I would really doubt you would owe them anything although some have clauses so you owe them EPC etc.

  • I can't see any clauses in the contract and they have used the epc that the old sellers.
    Do I have to keep it on the market for another 17 weeks? I will refuse viewings if I do.
    They are pushing me into this keep saying I will find something and sending me details of houses in areas I won't consider
