Distance selling - deposit refund??

As yet, and I assume this deal was done in the last 48 hours, have you had a positive refusal from the dealer to return your deposit?

If he has, whilst you didn't sign anything, you made a verbal contract to purchase the car, subject to your wife's approval of it - Wife doesn't like car so you don't want to proceed with the purchase.

The problem with verbal contacts is that either party can deny any pariticular terms were agreed, so it's your word against the dealers.

However against the £hundreds you put down as a deposit, to run this through the Small Claims Court will cost you around £80, which you'll get back if you win, plus any expense you incur in travelling to court & loss of earnings

The SMC formwork is on the web - Fill it in and send copies to the dealer, complete with a copy of your cheque to the court. A cheque is free till someone cashes it.

There is a good chance the dealer will roll over when he see's you mean business, and even if he doesn't you have better than a 50/50 chance of the court deciding that your deposit should be returned
