has anyone been turned down by FO

I was cold called by Min of Jus firm 2 years ago. Paid fee but they disappeared. Decided to go alone and wrote to lender. Told I was too late as Claim Recovery Co had written to them but did not proceed within 6 months with claim. Wrote to FO who upheld Lender defence. Surely I should be able to make claim as Claim Recovery Firm didn't do their job and I didn't know there was a 6 month limit. Can anyone help or had same experience?

    Why did you actually wait so long before proceeding alone?
    Also, why did you pay a fee to the claims company? You should not have to pay anything upfront. As for this firm being "Ministry Of Justice", all claims firms are regulated by the Ministry Of Justice.

    If you have any complaint at all, it's the claim firm you should be addressing.

    I was turned down by the FO. They took 2 years to decide but you could tell from the off they were looking to find ways to support the company and not the little person. I reckon you should use the FO reply to complain to the Min Just company and claim for either the compensation you should have received (ask the lender) or at least a refund of your fee. Don't forget you can use the small claims court if the Min Just company fails to pay up. Bear in mind you probably should have chased the Min Just company yourself at the time.

    They are NOT a Ministry Of Justice Company. The MOJ is their regulator but this does not give them any special status or government approval.

    As already stated, the OP should complain about the upfront fee charged by this company, but if (as I suspect from the OP's post) that they are no longer trading ("they disappeared") there isn't much chance of recouping anything two years on.

    The ministry of justice do not cold call. You were contacted by a company that is [losely] regulated by the MoJ. Not endorsed or recommended by or anything of that type.

    You employed them. They put a complaint in. It was rejected. You decided not to appeal the rejection.

    What absolute tosh that is. The FOS, if anything, is actually consumer biased. It follows law and includes fairness (Whereas law does not). If the FOS ruled against you it either means you had no basis for complaint or that there was no evidence to support your allegations.

    The company did its job. Just because the person lost, does not mean the company has done anything wrong. Many people lose their complaints. With some companies and some types of PPI, it is more unusual to win the complaint than lose it.

  • Yes the firm were Min of Jus registered and regulated by them. The Claims Company stopped answering calls after 3 months of telling me they were waiting for Lenders to revert to them. I eventually visited their offices which were closed.They were liquidated shortly after this. I then contacted Loan Company myself and they told me I had not responded in the 6 month period, a timescale I was unaware of. I explained I had been left high and dry by Claims handling Co but this was irrelevant to them.
    This is when I wrote to FOS who rejected my claim on the case being beyond the 6 month period. My claim was valid as I was self employed and was told I would not get consolidation loan unless I took out PPI. Has anyone been able to get a successful conclusion out of similar circumstances?

    Most PPI does cover the self employed. Did you check that yours didn't? A rejection suggests it did.

    Weak complaint. Anyone could make that allegation. Without evidence, complaints on that basis alone usually fail.

    No. Once timebarred and the FOS won't consider it then its game over.
