copyright on ebay

A question for all the experts

Iam going through some of my listings and revising them, and it is apparent that some of my photographs are being copied by one person in particular (they cannot even be bothered to crop my ex high streets shop name from the photographs).
I reported it to ebay on Saturday(just gone), ( I may of well have reported it to my hamster for all the good that did)
All I want is assurance that the photographs will be removed from other peoples listings.
Any ideas? :angry:

  • The exact same thing happened to me last month and I got all of the adverts that were using my pictures taken down. You'll get a better response from eBay if you phone them, I've not had much luck with the automated reports.. Make sure you have all the item numbers of the guy's listings, and of your listings that he's copied pictures from.

    Go through the Customer Support link on their site, click on Contact eBay, click on topics then click on Selling and pick a topic, I'd recommend "Listing Items for Sale". That will bring up the link on the right hand side that says "Call Us" and that will give you their phone number and a passcode so you can speak to someone. Don't use the report an item link as that will just take you to their automated doohickey for reporting things.

    When you talk to them, explain the problem but don't say "I want to report an item" as they might just tell you to use the form. Use these key points and explain them to the service rep:
    -You took these pictures yourself of items you have for sale, they are not stock photographs. If the items you have for sale are not BNIB but secondhand, ex-display or any other condition mention that as it's even more important in those circumstances to have photos of what you're actually selling.
    -The pictures were taken in your shop and show your shop and your other stock in the background.
    -By using your photos the guy who copied them is misrepresenting himself and the stuff he's selling. He's making it look like he has a shop, he's not showing pictures of the items he has for sale, and as he's left your shop name in some of the pictures he's (probably deliberately) confusing your customers into thinking that he's you!

    They should remove his listings within about 24 hours of getting your call, good luck!

    Did they copy your photo and upload it to ebay themselves, or just link to it? If it's just a link and the original pic is still on your server, you could always swap it for a different, unflattering pic ;-)

    In addition to this, if you create a blank small picture and put it in the middle of your description, then if the description gets copied they will also inadvertently copy your blank image. Then you can change the image to something else...

    phone them to get it sorted and if you have copyright attached to your photos tell them and they will remove them as they dont want legal trouble
