Hello, apologies if this has been covered.
Got a 'Parking Charge' from LDK. I purchased a ticked from the machine but (due to the wind) it ended up upside down on the dashboard. The ticket states 'no ticket'.
Should I appeal this and would I be successful, or just inform them I will not be paying as I had a ticket or just totally ignore them?

LDK Security Group are members of the BPA AOS so will get the vehicle registered keeper details from the DVLA & will pursue the RK so don't ignore.
Appeal then when that is refused take it to the "independent" appeals body POPLA where you are all but guaranteed to win with a properly prepared defence. I suggest that you start a new thread over on zhttp://forums.pepipoo.com/index.php?act=SF&s=&f=60 & provide all relevant details. Scan the ticket & remove identifying details & add that to your thread too.0 -
By way of background, during their history LDK have never, ever "done" court - not that that should be relied on now that we are post-Protection of Freedoms Act but they are not one of the companies to have recently issued a flurry of county court cases.
To add to the mix LDK have a sister company - a debt collection agency - known as Ethical Debt Recovery Services Ltd and although it hides behind a mail-drop registered office in north London it is actually based in exactly the same offices as LDK. They have been occasionally used by LDK to pursue their own debts but, of course, the link between the companies was not disclosed.
EDRS are not registered under the Consumer Credit Act and advertise their services on a business to business basis only which does not require their being registered. LDK are perfectly entitled to pursue their own debts without any necessity to register under the CCA and there is a somewhat unclear exemption to companies "part of a group" to pursue the debts of others in the same group under the same exception. However, the OFT has made it abundantly clear that if a third-party company is used to pursue private individuals (something that is deemed a "high-risk" activity) then it must be registered notwithstanding the group company exemption.
It would therefore be interesting to see if EDRS rear their head.
As has been said, challenge the issue of the ticket and, using the resources at the Private Parking Tickets & Clamping forum at pepipoo.com appeal to POPLA in due course. There are plenty of hoops through which private parking companies have to jump that many fail before an appeal is actually considered sufficient to ensure that no successful court action will ensue.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

The problem with the above advice is this could have happened in Scotland or N Ireland , so popla is not available in those parts of the UKWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
