    The rules about a good faith dispute is useful here.

    Paypal would side with the buyer - Ebay I would be happy to take my chances especially if I can talk to an agent (in Dublin, not Manila!) through the tracking and remind them off the good faith guidance.

    I am not going to get into a debate about a sense of 'entitlement', but would be happy to debate that too due to the lack of a buyer initiated Cancellation.

    I'm saying don't just roll over here..

    A good faith dispute does not occur if a buyer isnt carded, the delivery must show as 'refused' and even then, you have an uphill battle with CS and legally no leg to stand on.

    No one apart from the seller knows what the full track shows.

    Thank you for your replies.

    The buyer has opened a non receipt claim this morning, despite me telling them twice that the parcel has come back to me and please to confirm delivery address!!
    When I replied the tracking info was already in the system. I have noted the dates I sent messages to them via ebay and have requested details for delivery (in case they would prefer a work address). So we'll see what happens, I'm not keen to re-send to the same address for it to possibly be returned again.

    Do people not read their messages? So annoying! You do your best as a seller....

    They read them - they just don't want it now and instead of being honest they are messing your around.

    Refund and move on. Fight any bad feedback if sent.

    You could send a cancellation request for you fees back - but many idiots like this refuse them.
